The Service will notify the River District and CWCB <br />annually, no later than July 15, of its requested <br />initial pattern of delivery of the Fish Pool water <br />to the Subject Reach. Thereafter, the Service will <br />notify the River District and CWCB as soon as <br />possible by phone or by fax of any changes to the <br />pattern of delivery to the Subject Reach. <br /> <br />6. The Fish Pool releases to the Subject Reach will be <br />made during the period from March 1 through <br />December 1 annually as requested by the Service <br />pursuant to the CWCB MOA. The releases of the Fish <br />Pool water will be limited to a maximum of 200 cfs <br />based upon channel capacity constraints established <br />by the River District. Releases from the Fish Pool <br />will be measured at a u.S. Geological survey gage <br />below the outlet works of Wolford Mountain <br />Reservoir <br /> <br />7. The Service agrees to coordinate releases during <br />the months of July through October with releases it <br />will be requesting from Ruedi Reservoir. The <br />Service will give priority to delivery of Fish Pool <br />water at times when Ruedi releases to the Subject <br />Reach would cause locally unacceptable flow <br />conditions on the Fryingpan River below Ruedi <br />Reservoir. <br /> <br />B. The Bureau of Land Management shall include a condition <br />in the Permits for Wolford Mountain Reservoir enlargement <br />that will state: "If in the future the River District <br />does not provide 10 percent of the storable inflow to the <br />Fish Pool (provided that space exists in the Pool) in any <br />given year the Service may re-initiate section 7 <br />consultation on Wolford Mountain Reservoir under section <br />7 (a) (2) ESA. Accounting would be on an annual basis with <br />progress reports provided to the Service bi-weekly from <br />April 1 through October 31." <br /> <br />C. The River District commits to a coordination process with <br />the Service and Reclamation to provide flows for the <br />endangered Colorado River fish species to and through the <br />reach of the Colorado River from the Grand Valley <br />Irrigation company Diversion Dam downstream to the <br />confluence of the Colorado River with the Gunnison River. <br /> <br />D. The River District will continue to participate, through <br />operation of Wolford Mountain Reservoir and technical <br />support in the Recovery Program coordinated reservoir <br />operations project as described in the Recovery <br />Implementation Program Recovery Action associated Scope <br />of Work; provided that such participation can be <br />accomplished under Colorado law and water rights <br />administration in a manner that does not diminish the <br />
