5. The Service will notify the River District and CWCB
annually, no later than July 15, of its requested
initial pattern of delivery of the Fish Pool water
to the Subject Reach. Thereafter, the Service will
notify the River District and CWCB as soon as
possible by phone or by fax of any changes to the
pattern of delivery to the Subject Reach.

6. The Fish Pool releases to the Subject Reach will be
made during the period from March 1 through
December 1 annually as requested by the Service
pursuant to the CWCB MOA. The releases of the Fish
Pool water will be limited to a maximum of 200 cfs
based upon channel capacity constraints established
by the River District. Accounting would be on an annual basis with
progress reports provided to the Service bi-weekly from
April 1 through October 31."

C. The River District commits to a coordination process with
the Service and Reclamation to provide flows for the
endangered Colorado River fish species to and through the
reach of the Colorado River from the Grand Valley
Irrigation company Diversion Dam downstream to the
confluence of the Colorado River with the Gunnison River.

D. The River District will continue to participate, through
operation of Wolford Mountain Reservoir and technical
support in the Recovery Program coordinated reservoir
operations project as described in the Recovery
Implementation Program Recovery Action associated Scope
of Work; provided that such participation can be
accomplished under Colorado law and water rights
administration in a manner that does not diminish the
