REMEDIES OF MEXICO <br /> <br />The courts of the United States are without jurisdiction <br />to entertain suits between nations conccr)ling obligations <br />under international law, such matters not being judicially <br />cognizable.'8 Two other forums appear to be available: <br />an arbitral tribunal invoked under the -Inter-American <br />Arbitration Treaty of 1929 and the International Court <br />of Justice. <br /> <br />. <br /> <br />A. THE INTER-AMERICAN ARBITRATION TREATY" <br /> <br />Article 1 of the treaty provides that differences of an <br />international character arising between the parties which <br />"it has not been possible to adjust by diplomacy" and <br />which "are juridical in their nature by reason of being <br />susceptible of decision by the application of the principles <br />of law" may be submitted to arbitration. Article 1 states <br />that the contracting parties "bind themselves to submit <br />to arbitration" of such international differences. <br /> <br />Included in Article 1 among questions of a juridical <br />character are, inter alia, "the interpretation of a treaty" <br />and "any question of international law." We are of the <br />view that if negotiations between Mexico and the United <br />States fail to result in a solution of the W ellton-Mohawk <br />problem, arbitration may properly be requested to inter- <br />pret the rights of Mexico under the 1944 treaty as well as <br />to determine Mexico's rights under customary international <br />law. <br /> <br />. <br /> <br />B. THE INTERNATIONAL COURT OF JUSTICE <br /> <br />The compulsory jurisdiction of the International Court <br />of Justice similarly extends to all legal disputes concern- <br />ing "the interpretation of a treaty" and "any question <br />of international law." The declaration of the United <br /> <br />S3 Botiller v. Dominguez, 130 U.S. 238 (1889); George E.
