o
W
1iIiiIo.
~

.

I
I

.

I

26

waters to be delivered to Mexico because of the probability
that return flow waters would in the future undergo a pro-
gressive deterioration." As a result it appears that lan-

.

410ther authoritative witnesses expressed their opinion that the United
States was not obligated by the treaty to dclivOl' water or any partie-ulnr
quality. We think it is possiblo to interpret theso at,atoments, hOWCycl'J to
refer to the situation whero' the quality of water dotel'iorates due to normal
irrigation development ulong the river. rl'ho following statemonta appear
throughout tho hearings:

1. There is no guurn.nty in the treaty of the' source of supply or the
quality of {.LIly water. (Hearings, pt. 1, at 303, Statement on Behalf
of Arizona in Support of Ratification of the T'renty with Mexico.)

2. Senator Downey. And you are vcry positive that tho treaty does not
give any gllUl'anty to Mexico that the ,vater we deliver her shall be
of a quality that she shall usei
Mr. Tipton. Yes, sir. . .. (Hearings, pt. 2, at 324.)

3. Senator Downey. Now, I assume that JOu win agree, Judge Stone,
with what othor proponents of the treaty have said, that there is
neither directly nor indirectly set up in this treaty any implied guaranty
that the water that will go to Mexico will' be usable.
Mr. Stono. Yes; I 3gree to that. I think thore is express language
ill the treaty which provides that water which gOBS to Mexico must
bo accopted ill the quality as delivered and as passed to hor under
the treaty. (Hearings, pt. 5, at 1487.)

4. Senator Murdock. Is it your position that if the 1,500,000 acre-feet
aJlotted to Mexico SllOUld become so saline that it is not usable, but
still we furnish it; is that all that we are required to do under tho
tl'ca.ty1
Mr. Wallace. All we are required to do under the treaty is to
deliver that 1,50(),000 acro-feot of wator, without consideration of its
quality. (Hearings, pt. 5, at 1536.)

5. Sena.tor Downey. Consequently, if it happens that hecause Mexico
is at the lower end of the riyer a.nd she gots water that is so saline
that sho would not be able to uso it ultimately, you think that is all
right under this treaty?
Mr. Bashore. I think that is what this treaty contemplates. (Hoar-
iugs, pt. 5, at 1727.)

6. Mr. ArJlCson. So, three times it has beon made clear in the treaty that
what Mexico gets is 1,500,000 acre-feet of water from any and aU
sources, for any purposc whatsoevcr, fmd whatever tho origin.
Senator Downey. ]<':ven though it comes from seepage And drainage
water, and even thongh it become so 8ulino it is not usunblo by Mexico'
Mr. Acheson. Those are the plain words of the treaty, Senator.
(Hearings, pt. 5, at 1764-65.)
