However, <br />when the project contemplates no future diversion of stored water except <br />by livestock drinking, if stream water is required to replace evaporation <br />and seepage losses, or to prevent stagnation, application to appropriate <br />water as well as application to store water must be filed (Laws J961, <br />ch. 187). An application is required for permit ,to construct a. reservoir <br />(sec. 537,140). <br /> <br />. <br /> <br />Utah <br /> <br />The statutory provisions in Utah provide that all waters in this <br />State are declared to be the property of the public (sec. 73-1-1) and the <br />rights to the us e of the unappropriated public waters for beneficial purpose <br />can only be obtained through application to the State Engineer (sec. 73-3-1 &2). <br /> <br />In regard to the actual construction of a dam for stock-watering pur- <br />poses, Utah statutes (sec. 73-5-5) provide that plans and specifications <br />must be submitted and approved by the State Engineer if the capacity of <br />the impoundment exceeds 20 acre-feet., However, any use, regardles's of <br />the quant ity involved, requ ires an approved application. <br /> <br />Wyoming <br /> <br />T <br /> <br />A stock reservoir right is initiated by the filing of an application <br />to appropriate water with the State Engineer, as are all other water "rights <br />in Wyoming (sec. 41-201). Reservoirs used solely for stock-watering <br />purposes with a capacity of 20 acre-feet or less and with a height of dam <br />of 20 feet or le,ss are filed on a simplified application form which does not <br />require the filing of map on tracing linen (sec. 41-26). All reservoirs <br />for stock-water use in excess of 20 acre-feet or with height of dam greater <br />than 20 feet must be filed on regular form and he accompanied by a map on <br />tracing linen. The State Engineerrequires that any filing for a reservoir <br />with a capacity greater than 5 acre-feet must be certified by a registered <br />engineer or land surveyor (sec. 33-366, Wyo.
