The
extent of the development caused iCo::nC€Jrn because of possible inter-
ference with decreed water rights on thes e stream systems. Following
meetings with the Bureau of Land Management, it was agreed that
section 4 permits for the construction of stock-watering ponds would no
longer be granted until reviewed by the State Engineer.

, New Mexico

The doctrin,e of prior appropriation for beneficial use is and
always has been the controlling principle governing the appropriation
and use of water in New Me'xico. The doctrine is confirmed in the State
constitution and procedures and rules for its application are set forth
in the statutes.

A permit from the State Engineer is required to appropriate sur-
face water by construction of a tank or pond for stock watering only if
the capacity is to be greater than 10 ,acre-feet (sec. 75-8-3). Likewise,
approval of plans and specifications by the State Engineer is required
for a structure only in cases where the capacity is to exceed 10 acre-
feet, even though the height of the dam may exceed 10 feet (sec. 75-5~30).
In New Mexico the range carrying capacity seldom. exceeds 20 animal-
unit-years per section and impoundment of 10 acre-feet would in many
cas es be adequate to serve fou r to five sections of land, under a cceptabl e
range management practices. ,Where a need for stock water exists, dead
pool storage of 10 acre-feet is permitted behind flood control structures
built under Public Law 566 and by the Bureau of Land Management on
Federal land. No regulation on spacing of stock water tanks or ponds
has been adopted by the State of New Mexico.

Notwithstanding the fact that there is no statutory requirement
for permits, plans, and specifications for stock water ponds which impound
10 acre-feet or less, the owner is liable for any damages or impairment
caused by his appropriation of the water

Oregon

Oregon law, ORS 537,130, states:

"(I) Any person intending to acquire the right to the
beneficial use of any waters shall, before commencing
the construction, enlargement, or extension of any ditch,
canal or other distributing or controlling works, or per-
forming any work in connection with construction or pro-
posed appropriation, make an application to the State
Engineer' for a permit to make such an app:ropriation.

62

;;:~<:~/',~" '.: :;:.. - -."
':-',. ~ ._. ;:t\}.-.;~~:

:;:~.:~>((,

:'.>;:.

-"."

'.
