<br />In 1935 a considerable number of stock-watering ponds was con-
<br />structed in the Humboldt and Little Humboldt drainage basins. The
<br />extent of the development caused iCo::nC€Jrn because of possible inter-
<br />ference with decreed water rights on thes e stream systems. Following
<br />meetings with the Bureau of Land Management, it was agreed that
<br />section 4 permits for the construction of stock-watering ponds would no
<br />longer be granted until reviewed by the State Engineer.

<br />, New Mexico
<br />
<br />The doctrin,e of prior appropriation for beneficial use is and
<br />always has been the controlling principle governing the appropriation
<br />and use of water in New Me'xico. The doctrine is confirmed in the State
<br />constitution and procedures and rules for its application are set forth
<br />in the statutes.
<br />
<br />A permit from the State Engineer is required to appropriate sur-
<br />face water by construction of a tank or pond for stock watering only if
<br />the capacity is to be greater than 10 ,acre-feet (sec. 75-8-3). Likewise,
<br />approval of plans and specifications by the State Engineer is required
<br />for a structure only in cases where the capacity is to exceed 10 acre-
<br />feet, even though the height of the dam may exceed 10 feet (sec. 75-5~30).
<br />In New Mexico the range carrying capacity seldom. exceeds 20 animal-
<br />unit-years per section and impoundment of 10 acre-feet would in many
<br />cas es be adequate to serve fou r to five sections of land, under a cceptabl e
<br />range management practices. ,Where a need for stock water exists, dead
<br />pool storage of 10 acre-feet is permitted behind flood control structures
<br />built under Public Law 566 and by the Bureau of Land Management on
<br />Federal land. No regulation on spacing of stock water tanks or ponds
<br />has been adopted by the State of New Mexico.
<br />
<br />Notwithstanding the fact that there is no statutory requirement
<br />for permits, plans, and specifications for stock water ponds which impound
<br />10 acre-feet or less, the owner is liable for any damages or impairment
<br />caused by his appropriation of the water
<br />
<br />Oregon
<br />
<br />Oregon law, ORS 537,130, states:
<br />
<br />"(I) Any person intending to acquire the right to the
<br />beneficial use of any waters shall, before commencing
<br />the construction, enlargement, or extension of any ditch,
<br />canal or other distributing or controlling works, or per-
<br />forming any work in connection with construction or pro-
<br />posed appropriation, make an application to the State
<br />Engineer' for a permit to make such an app:ropriation.
