I think we have until the <br />end of the year to make a filing in water court and we will still have the <br />line six appropriation date so holding off for a short time will not produce <br />our appropriation on date or ability under the 581 cfs decree. So we <br />simply work on these other issues and when we think it's appropriate we <br />file the application in water court. <br /> <br />Okay, questions from the Board? Yes Tyler <br /> <br />Gene could you describe again what purpose of the MOU is? <br /> <br />Okay, the MOU would simply--well not simply, it's going to be fairly <br />complicated I believe but since the Service will rely upon this 581 cfs <br />appropriation to issues nonjeop~rdy opinions on water projects, they need <br />to be assured in fact that the Board will protect this water right, we will <br />enforce it against, lets say junior appropriators or changes that would injure <br />the 581 right. If--the Service believes that if such an agreement were not <br />in existence they could not rely legally on the appropriation to offset the <br />project impacts from a water project that might come along and Margo <br />may want to add to this, I hope I explained it correctly so it is an <br />agreement to protect and enforce the water right. I envision a similar <br />agreement on this as we have don on the Ruedi releases, the first 10,000 <br />acre foot of releases, that are delivered and protected in the 15 Mile <br />Reach.
