<br />e <br /> <br />e <br /> <br />Service on this, as I expressed our intent to do that the last time and we <br />feel that we will be able to work cooperatively on the minimum stream <br />flow issue, the 581 cfs, as well as the 15 Mile Reach recommendations and <br />the release of water from Ruedi Reservoir and other reservoirs. My clients <br />are prepared to move forward in advancing time, effort, perhaps even <br />money if a program can be established that would work. On the 581 cfs <br />I want to bring one point to your attention which is, unfortunately because <br />I'm a lawyer, is a legal point and I don't want us to get hung up on this but <br />I want you to understand our position that if the spirit of cooperation, if <br />the direction that we're going does not continue to product fruit for all of <br />us my position legally is that the 581 cfs is all that the Water Conservation <br />Board has authority, if they adopt that number, has authority to accept <br />grants for, to inter into leases for the preservation of the stream flow. Now <br />what do I mean by that, the reports that you will receive from the Fish and <br />Wildlife Service will indicate that a minimum of 700 cfs is what should be <br />established for the 15 Mile Reach. Preferably a flow from between 900 <br />and 1,100 cfs is the accepted flow the Service would like to achieve for that <br />reach, we support that because my clients are about solutions to the <br />problem but if the solutions involve a dramatic demand upon Ruedi <br />Reservoir you will hear me say in the future the following legal principal <br />and that is that the most the Water Conservation Board can accept at a <br />grant from or a gift from the Bureau of Reclamation in terms of water is <br />to establish 581 not 700, not 900, not 1,100 and the reason I will raise that <br />issue is obvious. If beyond the first 10,000 that water comes from Ruedi <br />Reservoir we will take the position that you are moving beyond the 581 <br />established flow that you seek to adjudicate in water court. Hopefully we <br />will be invited to participate and participate in a meaningful and positive <br />way not in a negative or legal way, meaningful and positive way to <br />accomplish both the charge of this Board as well as the Service and the <br />Bureau of Reclamation.
