<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />The State Engineer should appoint an Advisory Committee consisting of members <br />of the Trust Committee and other members representing both surface and <br />groundwater users in the basin for the purpose of providing advice concerning <br />approval of replacement plans and other matters related to any rules governing <br />measurement, diversion, and use of tributary groundwater in the Arkansas River <br />basin, <br /> <br />. Authorization should be provided to the State Engineer, as Director of the Colorado <br />Division of Water Resources, and the Attorney General to hire adequate additional <br />FTEs and that sufficient funds be allocated to cover the costs of employing and <br />equipping such personnel and to provide for the operating costs associated with full <br />implementation and enforcement of a groundwater regulation program within the <br />Arkansas River basin, <br /> <br />. <br /> <br />The Department of Natural Resources, which includes the State Engineer's Office, <br />the Colorado Water Conservation Board, the Division of Wildlife, and the Division <br />of Parks, should review the Water Acquisition Subcommittee's recommendations of <br />potential sources of penn anent water supplies that can be utilized to conjunctively <br />serve recreation and wildlife needs in John Martin Reservoir, Trinidad Reservoir, and <br />the Great Plains Reservoirs, as well as provide options for storage or operations of <br />augmentation water to facilitate solutions to groundwater pumping depletions, <br />Preferred alternatives are to be reported to the full ARCC for further consideration, <br /> <br />. Based upon current estimates by the Division of Wildlife and the Division of <br />Parks, the average annual needs for recreation and wildlife water are <br />approximately: John Martin Reservoir 3.000 AF, Great Plains Reservoirs 8,000 <br />AF, and Trinidad Reservoir 1,500 AF. Furthennore, the Division of Wildlife and <br />Division of Parks should continue to review their operations with respect to water <br />supply needs in order to coordinate their water supplies with those needed to <br />provide replacement water, <br /> <br />. Besides these fonnal recommendations, on June 26, 1995, the ARCC also adopted <br />a resolution supporting the effort by the Division of Parks to deliver additional water <br />to the enlarged pennanent pool at Trinidad Reservoir during 1995 under appropriate <br />circumstances, <br /> <br />. The ARCC was unable to reach sufficient consensus on the issue of whether, given <br />the option, it would be preferable for Colorado to repay Kansas for at least a portion <br />of the accumulated past depletions in water or money, On September 7, 1995. after <br />much discussion and reconsideration of a tentative recommendation, the ARCC <br />decided to defer a fonnal recommendation on this issue until later in the damages <br />phase of the litigation, <br /> <br />8 <br />
