<br />oGS~ <br /> <br />authorized re-operations of Fryingpan-Arkansas Project facilities and a re- <br />operations contract has been executed with an eligible entity. <br /> <br />The Winter Water Spill Credit would apply to spills of Winter Water stored in <br />Pueblo Reservoir by the Direct Flow Applicants of the Winter Water Storage <br />Program. Those entities are listed below: <br /> <br />Bessemer Irrigating Ditch Company <br />High Line Canal Company <br />Oxford Farmers Ditch Company <br />Catlin Canal Company <br />Las Animas Consolidated Canal Company <br />Riverside Dairy Ditch <br /> <br />The West Pueblo Ditch is also a Direct Flow Applicant of the Winter Water <br />Storage Program. West Pueblo Ditch water rights have now been changed to non- <br />agricultural purposes and West Pueblo Ditch will not be allowed any benefits of <br />the Winter Water Spill Credit. If and when other Applicants obtain a decree <br />which changes their water rights to non-agricultural purposes, they will no longer <br />be allowed any benefits of the Winter Water Spill Credit. <br /> <br />The Winter Water Spill Credit will apply to Winter Water stored in Pueblo <br />Reservoir by the Holbrook Mutual Irrigation Company, an Off-Channel Applicant <br />of the Winter Water Storage Program. In a year that a spill occurs, the Holbrook <br />Mutual Irrigation Company must have maximized its storage of Winter Water in <br />its own off-channel storage vessels in order to qualify for the Winter Water Spill <br />Credit. <br /> <br />The Winter Water Spill Credit will not apply to Winter Water stored by other Off- <br />Channel Applicants of the Winter Water Storage Program. <br /> <br />The Winter Water Spill Credit will only apply to Winter stored water spilled from <br />Pueblo Reservoir in accordance with the order of spill as prescribed in <br />Amendment No.4 to Contract No. 5-07-70-W0086. It will not apply to any <br />releases of Winter Water requested by entities or as required by the Winter Water <br />Storage Program Decree. <br /> <br />The Winter Water Spill Credit can be used as a credit towards purchase of Project <br />Water or as a credit towards future Winter Water Storage charges. The Winter <br />Water Spill Credit may be carried forward indefinitely by an eligible entity until <br />that entity's next purchase of Project water or Winter Water storage. <br /> <br />Historical records of the Winter Water Storage Program indicates that eligible <br />Applicants' average storage in Pueblo Reservoir under the Winter Water Storage <br />Program was approximately 48,000 acre-feet and maximum storage in Pueblo <br />Reservoir under the Winter Water Storage Program was approximately 62,000 <br /> <br />8 <br />
