<br />applicant detcnitincd it necessary to protest in ordcr to protc'Ct the
<br />conditional dec~ees which are the subject of this application. Appli-
<br />cant's protest nas been on file for nearly a year and this litigation is
<br />still pending. i

<br />4; Septernl::.er 13, 1978 a Statarent of Opposition was
<br />'forwarded to thE! Clerk of the District court for Water Division No. 6 in
<br />colIDection ,dth :Case No. W-1464-78, which is an additional application
<br />of Colorado-Ute :Electric Association, Inc. for a change of water rights
<br />in the Yarnpa Ri\ier or its tributaries. TI1is involves eight ditches in
<br />the Yarnpa River ~basin and applicant's protest arose tecause of concern
<br />over its conditional decrees which are the subject of this Application.
<br />It is expected that this litigation will consurre substanti31 additional
<br />tinE and expense.

<br />5.~ During a substantial portion of the past four years
<br />applicant's courisel in Craig, Colorado, R. H. Peck, Esq., has made a
<br />detailed review of all water applications filed in Water Division No. 6
<br />so that applicarit can determine, based upon his reccmrenda tions, whether
<br />it is necessary :to file protests to the sarre in order to protect the
<br />cnnditional decrees that are the subject of this Application. Applicant
<br />of course in=d on-going expense because of the continuing perfornance
<br />of this impxtarjt fW1ction.

<br />part hereof, arnlicant has in=red the expenses set forth on said
