The author does nol <br />believe the Slate Board has these powers to the detriment of the <br />powers granted to the Secretary by the Boulder Canyon Project Act. <br />If, however. it i~ determined Ihat a contractor has the power under <br />state law 10 sell so.called conserved water without the approval of <br />(he olher California waler contractors and the' Secretary, these ques- <br />tions will need to be addressed. <br /> <br />V. SALE OR TRANSFER OF INDIAN R:EsERVED WATD RIOHT! <br /> <br />This porlion of Ihe anicle will deal with a problem that hangs <br />over Ihe heads of presenl users of Colorado River water, parcicularly <br />in the lower Basin. The problem deals with quantification and use <br />or Indian reserved watcr rights in the overall Colorado River Basin. <br />These rights. commonly referred to as Winters rights, when finally <br />identified in full may well constitute a significant portion of the tOlal <br />available supply of lhe water of the Colorado River System. <br />The doctrine or IndiaR" reserved waters was first enunciated by the <br />United doctrine of States Supreme Court in the 1908 decision of <br />Winlers .... United States: IU The Court held that when Congress created <br />an Indian reservalion, it impliedly reserved waler for the benefit of the <br />reservation when water is necessary to rulfill .the purposes of the <br />reservation. <br />In examining Ihe circumstances or each reservation. courts are to <br />look to the reOlson for the creal ion of the reservation,l" the charac- <br />teristics of the land, and the needs of the Indians.
