Mr. Knapp was also of the opinion that no hard and fast rules <br /> <br />could be adopted during the early stages of administration, and that the pro- <br /> <br />cedure of.the administrative officials must necessarily be guided by the re- <br /> <br />quirements, from time to time, of the water users in both states and the,~ <br /> <br />""---- --,.- <br /> <br />availability of water supplies to meet the same within the requirements of :the.' . <br />Stipulation. <br /> <br />i <br />&1 <br />:i' <br />r <br /> <br />At our first meeting, Mr. Knapp agreed that Kansas should accept and be <br /> <br />, <br /> <br />charged with, all deliveries of useab1e water crossing the state line as <br /> <br />measured at the official gauging stations near Holly. He was also agree- <br /> <br />able to limiting the application of the Stipulation to water which was then <br /> <br />stored in Caddo a Reservoir together with that which later entered the <br /> <br />reservoir and to the river accretions below the reservoir, and also in the <br /> <br />interest of minimizing administrative problems, to confine administration <br /> <br />of the Stipulation to diversions by the principal ditches diverting out <br /> <br />of the main stem of the Arkansas River only, beginning with the Bessemer <br /> <br />Ditch. It was for this reason that our progress reports to the Adminis- <br /> <br />trative Committee of the Arkansas Valley Ditch Association, and the attach.- <br /> <br />ed tabulations of diversions of water, exclude diversions by the ~est Pueblo, <br /> <br />Booth Orchard Grove and Excelsior Ditches and by the City of Pueblo and <br /> <br />other municipalities. <br /> <br />Mr. Knapp also agreed that the water in storage in Caddoa Reservoir on <br /> <br />April 1st, should be considered as temporarily regulated stream flow, and <br /> <br />not "Surplus" water as defined in the Stipulation. <br /> <br />A determination as to whether status quo requirements of the Stipulation <br /> <br />as regards uses of water below Caddoa Reservoir have been met, involved no . <br /> <br />. particular difficulties. <br /> <br />','. <br /> <br /> <br />it <br />
