<br />081032 <br /> <br />, ( <br />I . <br />I <br /> <br />NOVEMBER <br />8 1943 <br /> <br />-._"- <br />'---, <br /> <br />REPORT ON THE ADMINISTRATION OF THE ARKANSAS RIVER-- <br />UNDER <br />THE COLORADO-KANSAS STIPULATION OF 1933. <br /> <br />- - - - - - - - - - - - - - - - - - - - <br /> <br />Prior to the initiation of administration of the Stipulation, the State <br /> <br />Engineer of Colorado conferred with representatives of the Attorney General's <br /> <br />office and Counsel for the Arkansas Valley Ditch Association first on February <br /> <br />3rd, and subsequently at other times. Other conferences between the officials <br /> <br />of Colorado and of Kansas were held to consider questions relating to int'~r.." <br /> <br />pretations of the prOVisions of the Stipulation and administration. The <br /> <br />last oonference was held.on August 19th between the Attorneys General of <br /> <br />Colorado and Kansas, the two State Engineers, Counsel for the Arkansas Valley <br /> <br />Ditch Association and other ditches, and representatives of the Colorado Water <br /> <br />Conservation Board. At the several meetings of the Colorado representatives, <br /> <br />l.t was the consensus of opinion that the Stipulation posed many original and <br /> <br />involved questions of administration not theretofore presented, which called <br /> <br />for the exercise of tolerance and patience on the part of the water users <br /> <br />pending the forthcoming decision of the Supreme Court of the United States <br /> <br />which would determine future administrative procedure. It was also .the con- <br /> <br />sensus of opinion at the early conferences, that due to the involved character <br /> <br />of conflicting interests, it would be necessary that the State Engineer of <br /> <br />Colorado exercise his discretion in meeting many problems as they arose from <br /> <br />
