<br />. (3) To have and to exercise the power of
<br />ernment domain and dominant eminent domain
<br />and in the manner provided by the law for the
<br />condemnation of private property for public Use
<br />to take any property necessary to the exercise of
<br />the powers herein granted; provided, such district
<br />shall not have or exercise this power of eminent
<br />domain over or by means thereof to acquire the
<br />title to or beneficial use of vested water rights for
<br />transmountain diversions, and in connection there-
<br />with such district shall not have the power to
<br />carry or transport water in transmountain diver-
<br />sion, the title to which has been acquired by
<br />any municipality by virtue of eminent domain
<br />proceedings against any such vested rights.

<br />(5 ) To contract with the government of
<br />the United States or any agency thereof for the
<br />construction, preservation, operation and main-
<br />tenance of tunnels, resenoirs, regulating basins,
<br />diversion canals and works, darns, power plants
<br />and all necessary workE! incident thereto, and to
<br />acquire perpetual rights to use of water from such
<br />works j to sell and dispose of perpetual rights to
<br />the use of water from such works to persons and
<br />corporations, public and private.

<br />(9) To adopt plans and specifications for
<br />the. works for which the district was organized,
<br />which plans and specifications may at any time
<br />be changed or modified by the Board. Such plans
<br />shall include maps, profiles, and such other data
<br />and descriptions a8 may be necessary to set forth
<br />the location and character of the. works, and a
<br />copy thereof .hall be kept in the office of the
<br />district and open to public inspection.

<br />(10) To appropriate and otherwise acquire
<br />water and water rights within or without the
<br />State; to develop, store and transport water; to
<br />subscribe for, purchase and acquire stock in canal
<br />companies, water companies and water user as-
<br />sociations ~ to provide, sell, lease and deliver
<br />water for municipal and domestic purposes, ir-
<br />rigation, power, milling, manufacturing, mining.
<br />rnetallurp;ical and any and all other beneficial
<br />uses and to derive revenue and benefits there-
<br />from; to fix the terms and rates therefore; and to
<br />make and adopt plans for and to acquire, con-
<br />struct, operate and maintain dams, reservoirs,
<br />canals, conduits, pipelines, tunnels, power plants
<br />and any and all works, facilities, improvements in
<br />property necessary or convenient therefore, and
<br />in the doing of all said things to obligate itself
<br />and execute and perform such obli~ations ac-
<br />cording to the tenor thereof; provided, the sale.
<br />leasing and delivery of water for irrigation and
<br />domestic purposes as provided in this section
<br />shall only be made for use within the district.

<br />
<br />Colorado State Statutes provide the District shall
<br />be under the direction of a Board of Directors repre~
<br />senting the area covered by the District. The District
<br />Court Order creating the Southeastern Colorado Water
<br />Conservancy District in 1958, ruled that each of the
<br />nine Counties in the District would have two appointed
<br />Directors with the exception that one Director would
<br />represent that portion of Prowers and Kiowa Counties
<br />within the District. Other Counties repre8ented are:
<br />Chaffee, Fremont, El Paso, Pueblo, Otero, Crowley
<br />and Bent.

<br />The designated members are obligated to carry
<br />out the provision of the State Statutes, and are bound
<br />by such other agreements and contracts as are entered
<br />into by the District in the conduct of water business
<br />in the interest of present and future citizens within the
<br />confines of the District. It is important to note that
<br />the District boundaries do not represent the entire
<br />county, but only those portions where citizens Peti-
<br />tioned to become a part of the District.

<br />In 1975 the members of the Colorado General
<br />Assembly Amended the Water Conservancy District
<br />Act to provide that the terms of Directors would he
<br />staggered to provide greater continuity. On April 15,
<br />1976, the Honorable Matt J. Kikel, Presiding Judge,
<br />Division A, Pueblo, Colorado, appointed the following
<br />Directors for new terms of Office:
