<br />" <br /> <br />f\.) <br />"'-J Fish and Wildlife Service (FWS) <br />(.0 <br />(:;;) The Council is pleased with the coordination which has <br /> <br />been developed between FWS, Reclamation, and USDA. <br /> <br />The Council is aware of the responsibilities of FWS <br /> <br />under the Fish and Wildlife Coordination Act, but it is <br /> <br />important that FWS recognize that the replacement of fish <br />and wildlife values foregone is a totally voluntary <br />acti vi ty in the USDA ColoradoRi ver Salini t)'. Control <br /> <br />Program established by Congress inP. L. 98-569. The <br /> <br />specific intent of Congress with regard to the replacement <br /> <br />of fish and wildlife values foregone as a result of <br /> <br />salinity control activities ,is stated in the House <br /> <br />Committee Report to H.R. 2790 (P.L. 98-569). The report <br /> <br />reads: <br /> <br />"( 2). Any salini ty .control unit or discrete portion <br /> <br />thereof authorized by subsection (a) may include <br /> <br />measUres to replace incidental wildlife values foregone <br /> <br />as a result of constructing that unit or discrete <br /> <br />portion thereof, except that-- <br /> <br />(A) such measures shall not significantly diminish the <br /> <br />salinity improvement to be achieved by the unit; <br /> <br />(B) use of water for such measures shall be in <br /> <br />accordance with State water law; <br />(C) to the extent practicable; the measures undertaken <br /> <br />shall minimize the use of water; and <br /> <br />(D) the cost of such measures shall be only a minor <br /> <br />..,.11- <br /> <br />L <br />
