<br />ANNUAL REPORT FOR 1964 <br /> <br />Attorney Philip Danielson, Attorney for the Ditch AssocIa- <br />tion, is the Attorney directly in charge of this matter. We along <br />with other local ditch attorneys are of course active in the matter <br />in the interest of our particular clients. <br /> <br />Mr. Danielson and the Attorney for the Model Reservoir <br />have, through many months of effort, worked out a compromise <br />suggested Court Decree, allowing this change of storage with <br />cenaln safeguards for water users below the project At the ditch <br />meeting held in La Junta on January 22, 1965, the majority of the <br />Ditch Association voted to accept this Decree. The Amity Board <br />and Ft. Lyon Board withheld their dectsion. I might say the Ft. <br />Lyon and C. F. & 1. had entered appearance in Court individually <br />and separately from other ditch association members. It Is <br />assumed bY the time this report Is printed, your Board will have <br />reached their dectslon, but as of this ttme it is not available for <br />inclusion in this report. <br /> <br />The last specific item included herein concerns the pending <br />litigation against the Oxford Farmers Canal and Highllne Canal In <br />connection with alleged illegal diversions by both companies by <br />means of wells. This case is being handled on behalf of the <br />oppOsing and interested ditches affected by Atiorney Glenn <br />Saunders of Denver, and your Board and Attorneys ate in constant <br />touch with him and participating to the fullest extent necessary to <br />protect your rights. The legal details are somewhat detailed and <br />will not be reported here but will undoubtedly be discussed at <br />our Annual meeting. <br /> <br />We once again wish to thank you the stockholders, the <br />board members, the superintendent and staff for their excellent <br />cooperation In helping us In performing our services during the <br />past year and, if it is your desire, we look forward to future years <br />of service In the interest of your Company. <br /> <br />Respectfully submitted, <br /> <br />AUOTT AND ROGERS.
