In the same year the, new water law W(;IS adopted <br />The Colorado Water Determination and Administf'ation P,ct, Following <br />that, that law was adopted to give the man with the pump an oppor- <br />tunity to come and get a decree without spending a lot of money <br />and get a decree as of the date of the, drilling of his pump. Fol- <br />lowing efforts of pumpers to obtain waters by the eradication of <br />phreatophytes and a decree which would augment their wells and let <br />them pump at times when they otherwise could not do so. this case <br />(Shelton) is currently in the Colorado Supreme Court and. has not <br />yet been decided. The next major type of development which occurred <br />at the same time was the developer of lands, The stock market <br />basicall, collapsed in 1969 and people who hod been burned saw another <br />golden wand available in the form of land and they all rushed in <br />to buy lands and it ballooned values a~d everybody all of a sudden <br />decided they had to own an acre of lan~. In order to get water <br />rights, the developers then commenced a series of what they called <br />augmentation cases, but reolly which were no augmentation of any- <br />thing but simply they would buy dry la~d and utilizing the "in-house" <br />w~il concept would sell lots to on individual who was told, and <br />basically the legislature <:reated for, him .the pos,sibili ty, that he <br />(the ,lot owner) could drill 0 well for "in-house" use only, These <br />eases, 0 large number, were approved in many of the woter divisions <br />over Colorado under the new 1969 low, but in Woter Division 2 the <br />district opposed these developments and ta this date really there <br />,~oYe. been very few, only one (~len-Terra), approved in Wet Mountain <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />
