Feast <br />Newsletter Editor <br /> <br />OFFICIAL PUBLICATION OF THE COLORADO WATER CONGRESS <br /> <br />Gordon Scheer <br />Executive Director <br /> <br />1200 Lincoln, ~530 <br />Denver, Colo. 80203 <br /> <br />WATER WELLS BROUGHT UNDER PRIORITY SYSTEM <br /> <br />A DIVISION I WATER COURT decision issued on July 26 ruled that the <br /> <br />diversion of water by wells from the tributary underground in the South <br /> <br />Platte Valley must conform to the priority system the same as do diver- <br /> <br />sions from the surface waters of the South platte River. <br /> <br />The ruling came in a temporary restraining order ordering the Weldon <br /> <br />Valley Ditch to discontinue diversion in accordance with an order of the <br /> <br />State Engineer to meet the call of the Schneider Ditch which was later <br /> <br />called out by the North Sterling Ditch. <br /> <br />The lawsuit started when the ditch company elected not to conform <br /> <br />to the State Engineer's order because no restriction had been put on the <br /> <br />hundreds of wells in the area which were pumping from the underground <br /> <br />tributary aquifer. The State Engineer, represented by James Geissinger <br /> <br />of the Attorney General's office, brought suit to compel Weldon Valley <br /> <br />to cease diverting in conformity with the call on the river. <br /> <br />The ruling which was handed down by District Judge Earl A. Wolvington, <br /> <br />Sterling, sitting on the bench for Water Judge Donald A. Carpenter, <br /> <br />Greeley, provided that: <br /> <br />'2'7'71 <br />
