<br />, <br /> <br />. . <br /> <br />APPENDIX I <br /> <br />M~SSOURI RIVER BASIN STATE POSITION <br /> <br />Presented to the Ad Hoc Committee on Water Marketing <br />June 5, 1974 <br />Ramada Inn, Smith Road <br />Denver, colorado <br /> <br />The long-range policy matters related to the water marketing should <br />be referred to the Missouri River Basin commission for study and re- <br />commendation; that in the interim period individual states should <br />work with Federal agencies to resolve the immediate problems. ~ne <br />following principles shall be used as guidelines in resolving these <br />immediate problems. Should there be any contemplated deviation there- <br />from, such state should so notify the 10 Missouri River Basin state <br />representatives. <br /> <br />1. For the purpose of these discussions we are considering only <br />heavy industrial water users (5,000 AF/yr or greater consump- <br />tive use). <br /> <br />2. Any actions of the federal agencies relative to marketing water <br />for industrial use in the Missouri River Basin shall follow state <br />law and require as a condition precedent that the water user en- <br />tering into any contract with the federal government for surplus <br />water obtain a state water permit. <br /> <br />3. The state shall have the first right of refusal to market avail- <br />able water supplies. <br /> <br />4. Applications for industrial water supply pending before federal <br />agencies for water from federal reservoirs in Montana for use <br />exclusively within the state shall be suspended until an agree- <br />ment is negotiated with the State of Montana. <br /> <br />5. User charges for industrial water shall be determined by the <br />state except in those cases where the state decides not to be <br />the marketing agent. <br /> <br />6. Charges for industrial water at the federal level should be only <br />that amount required to compensate the basin account for revenue <br />foregone. <br />
