,

. .

APPENDIX I

M~SSOURI RIVER BASIN STATE POSITION

Presented to the Ad Hoc Committee on Water Marketing
June 5, 1974
Ramada Inn, Smith Road
Denver, colorado

The long-range policy matters related to the water marketing should
be referred to the Missouri River Basin commission for study and re-
commendation; that in the interim period individual states should
work with Federal agencies to resolve the immediate problems. ~ne
following principles shall be used as guidelines in resolving these
immediate problems. Should there be any contemplated deviation there-
from, such state should so notify the 10 Missouri River Basin state
representatives.

1. For the purpose of these discussions we are considering only
heavy industrial water users (5,000 AF/yr or greater consump-
tive use).

2. Any actions of the federal agencies relative to marketing water
for industrial use in the Missouri River Basin shall follow state
law and require as a condition precedent that the water user en-
tering into any contract with the federal government for surplus
water obtain a state water permit.

3. The state shall have the first right of refusal to market avail-
able water supplies.

4. Applications for industrial water supply pending before federal
agencies for water from federal reservoirs in Montana for use
exclusively within the state shall be suspended until an agree-
ment is negotiated with the State of Montana.

5. User charges for industrial water shall be determined by the
state except in those cases where the state decides not to be
the marketing agent.

6. Charges for industrial water at the federal level should be only
that amount required to compensate the basin account for revenue
foregone.
