Knapp that the two State Engineers had <br /> <br />been employing the same formula, or methods of calculation and aocount- <br /> <br />ing, until about July 20th, at which time 11r. llinderlider adopted anoth- <br /> <br />er and different plan. This change in methods of calculation was admit- <br /> <br />ted by Mr. Hinderlider, and was defended bY' him on the grounds that the <br /> <br />original and tentative formula had proven to be inaccurate and inapplioa- <br /> <br />ble, involving too many uncertainties due to changing conditions and re- <br /> <br />quiring too lnany assumptions; and that a different plan v~s neoessarY' in <br /> <br />order to carry out the intent of the 1933 stipulation. For these reasons <br /> <br />a new plan was devised by- him which. for want of a more appropriate term, <br /> <br />is herein desig;nated a plan based on "historio average diversions. n As <br /> <br />herein later explained the Knapp Plan. based on so-called "out-of-prior- <br /> <br />itY' diversions," was also revised in major items of procedure after the <br /> <br />i.ni tial caloulations had been submitted. covering periods early in the <br /> <br />1943 season. <br /> <br />The plan devised by Hr. IIi.nderlider. for oalculating the addi- <br /> <br />tional diversions of Colorado ditches upstream from Caddoa during April, <br /> <br />Hay. June and July, and for indioating the status of interstate rela- <br /> <br />tions as of August 1, 1943, is based on comparisons or differenoes be- <br /> <br />tween. (a) the total diversions of 10 selected upstream ditohes in 1943; <br /> <br />and (b) thsir "historic average diversions," - meaning their average di- <br /> <br />versions in acre feet in the same months of the period 1908 to 1938. <br /> <br />Aggregate diversions of the 10 selected ditches d'-ring the 4 months of <br /> <br />1943, said to total 313,238 A,F.. are compared with their "historio <br />
