Knapp, that one-half the water stored in Caddoa Reservoir as of <br /> <br /> <br />April 1, 1943 (about 48,000 A.F.) should be allocated to Kansas, some of <br /> <br /> <br />the Colorado water users urged that all of it be claimed by ColoradO. It <br /> <br /> <br />was pointed out that the said storage had been accomplished largely at <br /> <br /> <br />the expense of Colorado ditches and without depriving Kansas of any water <br /> <br /> <br />that was needed in that State or which might have been claimed under the <br /> <br /> <br />1933 Stipulation. <br /> <br /> <br />In brief, the records disclosed that from January 15, 1943, <br /> <br /> <br />when the control gates in Caddoa Dam were closed to facilitate the com- <br /> <br /> <br />pletion of construotion and when storage of the water be~, to March <br /> <br /> <br />11, 1943, when the control gates were partially opened to release natu- <br /> <br /> <br />ral flows entering the reservoir, the Colorado ditohes below Caddoa <br /> <br /> <br />made no diversions from the Arkansas River. That they v.ere thus de- <br /> <br /> <br />prived of water is indicated by the fact that, from January 1-15, just <br /> <br /> <br />prior to olosing the control gates, the Colorado ditches below Caddoa <br /> <br /> <br />had diverted 3,450 A.F. from the river, and from March 11-31, just after <br /> <br /> <br />the gates were opened, they diverted 5,130 A.F, Had the Stipulation of <br /> <br /> <br />1933 been in effect and been interpreted as allooating quantities in the <br /> <br /> <br />winter season up to 42,100 A.F. to ColoradO and up to 25,000 A.F. to <br /> <br /> <br />Kansas, then, as compared with the total of 8,450 A.F. diverted by Colo- <br /> <br /> <br />rado ditches below Caddoa during January, February and March, the Kansas <br /> <br /> <br />share or status quo allocation would have approximated 5,000 A.F. Ac- <br /> <br /> <br />tually, the Stateline flows amounted to 15,760 A. F. in January, 8,620 <br />
