Since that <br />time ~ have further refined this decree to insert in it all possible <br />sateguards for the Ami1;y, and during the year your board, as well <br />as other interested water users, approved this decree. <br /> <br />Also in the report we made last .rear, we called your attention <br />to the fact that your company, along with other interested water users, <br />all represented by Attorney Glen Saunders, of Denver, had begun action <br />to stop the Oxford Farmers Canal and Highline Canal from diverting <br />water by use of wells into their irrigation systems. We believe, and <br />we think Mr. Saunders also believes, that new legislation passed by <br />the State In 1965 is of such a nature as to give the State Engineer <br />sufficient authority to deal with this matter without tile instigation <br />of a law suit by the interested water users. We hope this is true, <br />but durIng the 1966 irrigation season, should the same problem arise <br />and not be corrected by the State Engineer. we feel sure your board, <br />along with the other interested ditch companies, will proceed promptly <br />to protect our rights and theirs. <br /> <br />It is never pleasant to report to you that we have become involved <br />in a law suit. However, as you all probably know, a law suit for dam- <br />ages in considerable amount has been filed against j'OlIr company on <br />about July 5, 1965. This suit was brought against the Ami1;y by Jalte <br />O. Broyles and Mary A. Broyles and arose out of the flood which took <br />place around June 17, 1965. <br /> <br />] <br /> <br />In essel'lEl, the Plaintiffs in this suit make the charge that their <br />lands, crops, vehicles and other property was damaged by the flood <br />and that the Ami1;y was responsible for this damage due to the fact <br />the Amity darn and other portions of the Amity system were not kept <br />in good order and repaIr and were not managed properly. <br /> <br />This law suit is being defended, on behalf of the Amity, by your <br />undersigned attorneys, as well as by the law firm of Phelps, Fonda <br />and Hays of Pueblo. At the present time no definite trial date has been <br />set and we cannot predict Motten this matter will come to trial. You <br />may be assured that all possible efforts wlU be exerted on behalf of <br />your company in connection with this matter. <br /> <br />Once again we reach the opportunity to thank each and every <br />stockholder of the company for their cooperation and efforts, during <br />the past year, designed to make the operations of the canal a success. <br /> <br />We also wish to express our appreciation to the members of the <br />Board, the Superintendent and staff for their confidence in us and their <br />excellent cooperation with us in handling the legal aspects of your <br />canal operation. <br /> <br />RespectfuUy submitted, <br /> <br />ALLOTI' AND ROGERS, ATTORNEYS <br />B~': ROBERT G.
