Approximately 1,000 private or public organizations and individuals
who irrigate land in the states of Colorado, Montana, Utah and Wyoming'

have recently received irrigation return flow permit applications from

.
the U. S. Environmental Protection Agency (EPA).

Completion of permit applications is the first step in the
implementation of Section 402 of the Federal Water Pollution Control
Act Amendments (FWPCAA) of 1972 that established a National Pollutant
Discharge Elimination System (NPDES). Under the terms of the NPDES,
nearly anyone discharging wastewaters into the Nation's streams from
,a point source (ditch, pipe, etc.) must now have a permit to do so
from the EPA or an authorized state water pollution control agency.

Final reg"lations governing discharges from irrigated areas

were published in the July 5, 1973, Federal Register. NPDES requirements
apply to dischargers of irrigation return flows operated by public or
private organizations and individuals if 1) there is a point source
of discharge; and, 2) the return flow is from land areas of more than,

3,000 contiguous acres or 3,000 non-contiguous acres which use a common

drainage system.
