<br /> <br />. Provide the improvements, such as high-speed lifts and advanced snowrnaking <br />systems, and expansion needed to ensure that the Snowrnass Ski Area remains <br />economically stable and capable of providing quality skiing experiences. <br />. Improve existing public access to NFSL and ensure its provision in the <br />long term, for a variety of recreational activities. <br /> <br />There is a need to upgrade existing services and expand the type and quality of <br />services and facilities at Snowrnass to accommodate additional winter and summer <br />uses and evolving customer preferences for recreational events within and <br />adjacent to this permit area. The ForeSt Service desires that the Snowrnass Ski <br />Area remain a viable operation so. that high-quality public recreation <br />opportunities continue to be of,fered over the long term. The addition of high- <br />quality terrain, expansion of snowrnaking coverage to enhance earlier openings, <br />replacement of outdated lift equipment, and renovation and/or addition of <br />restaurant and support facilities would measurably improve the overall <br />recreational experience at the ski area. Additional parking facilities, a new <br />ingress/egress portal, and/or enhanced mass transit will improve the visitor <br />experience when entering and leaving the ski area. <br /> <br />C. RELATED PERMITS, PLANS AND ACTIONS <br /> <br />There are many federal, state, and local laws and regulations which affect <br />development and operation of the Snowrnass Ski Area. ASC is required by its <br />Special Use Permit to comply with all present and future state and local laws, <br />ordinances or regulations which are applicable to the area or its operations, to <br />the extent ~hat they are not in conflict with federal law or policy. The Forest <br />Service assumes no responsibility for enforcing laws, regulations or ordinances <br />which are under the jurisdiction of other governmental bodies. Nor is the agency <br />bound, by the actions of the TOSV or Pitkin County in reviewing/approving proposed <br />development on NFSL. <br /> <br />Impacts to the waters of the U.S., including wetlands, are regulated by the U.S. <br />Army Corps of Engineers (CaE). CaE has indicated that a single Section 404 <br />permit, rather than separate permits, for the discharge of dredged or fill <br />materials into waters of the U.S., including wetlands, will be required for both <br />development on NFSL and for connected actions occurring on private land, <br />including the East Village lift, parking lot and trails. A Section 401 Water <br />Quality certification from the Colorado Department of Health, Water Quality <br />Control Division, would be required in conjunction with Section 404 permits <br />obtained from CaE. <br /> <br />Construction activities on NFSL, including clearing, grading, excavation and <br />other ground disturbance activities, will require' Construction Stormwater <br />Discharge Permits from the Colorado Department of Health, Water Quality Control <br />Division. A Stormwater Management Plan will be required, as part of each permit, <br />to identify potential sources of pollution from stormwater discharges associated <br />with construction activities and the mitigation measures to be implemented. <br /> <br />Additional snowrnaking will require authorization by the Snowrnass Water and <br />Sanitation District (SWSD) for the necessary water withdrawals. The District has <br />been granted water rights by the State of Colorado to divert water from Snowrnass <br />and Brush Creeks for municipal and industrial purposes. Forest Service approval <br />of additional snowrnaking on NFSL will be subject to the minimum streamflows <br />established by the CWCB. <br /> <br />The Aspen area is a nonattainment area for compliance with air quality standards <br />under the Colorado State Implementation Plan (SIP). The Clean Air Act Amendments <br />of 1990 prohibit federal actions which do not conform with the SIP. <br />specifically, activities on federal land cannot cause or contribute to new <br />violations, increase the frequency or severity of existing violations, or delay <br />timely attainment of compliance with the' SIP. Although the Snowrnass Ski Area is <br />located outside the Aspen nonattainment area, the proposed expansion could <br /> <br />Summary . 2 <br />
