At the request of the CDOW, the Attorney General's Office has
reviewed the chain of title to the wells and concluded that Chiles does have good title.

Some of the major characteristics of the existing deep wells are summarized in Table 4-1.

Table 4 -I, Summary of Deep Wells

Well Permit Permit Use Adjudicated Amounts Est.
No. No. Use(s) GPM Ac-Ft Depth
(Ft)
I 2292-F Irrigation Irrigation and 1,800 960 2,500
commercial
2 14051 Irrigation Irrigation and 1,000 530 1,500
commercial
3 14052 Irrigation Irrigation 500 N/A 900

No information regarding the condition of the wells is available at the present time.
However, since all three wells have apparently been in service about 40 years, its possible
that one or more may have to be reconstructed or replaced sometime in the not too far
distant future. Duane Helton has indicated that the cost of replacing Well Nos. I and 2
may be about $350,000 based on information he had collected during his appraisal of the
water supply. The
FishPro report states that no information was found regarding volumes, decrees or
permits for this source and that it appears to be a surface water collection system and may
not actually be a cased well.

Surface Water SUDDlies

In addition to the groundwater, three shares of stock in the Commonwealth Irrigation
Company are associated with ownership of Chiles Farms. The appraisal report by Darwin
Asper provides an estimate of the average annual yield of the Commonwealth shares at
115 to 120 acre-feet per share. The Commonwealth shares could conceivably be used for
augmenting any new well or wells, which may be needed from the confined' aquifer or
shallow aquifers.

4-2
