"Scott used his office to further th.
ambitions of his law partner, and
Ulat is just wrong," McKennis said.
Holliday said, however. that he
planned to reprimand Elliott before
receiving McIMis'leller.

"If someb()dy's trying to make
something out of thla, d's lfi.iblY
unfair," Holliday said.
"I pulled Mr. Elliott ofllhe project
because he commented
prematurely. No way could we have
been credible on the project if I
assigned it to a person who said at
the start, 'I hate it. It's a terrible
project.' "

McInnis insisted that he main-
tained an "arms' length" distance
from Hellsgate. He said he found it
"ironic" that his actions two years
ago su:iace just" week befvre the
election.

"As far .as my opponent is con-
cerned, he knows he's in the last
week of an election that he's losing,
and. he's going to do anything he
can," McInnis said.

Shaeffer said he doubted if any
farmers would put their names down
on a piece of paper to buy the water
"no matler what the cost."
uIt's a matter of economics of
agriculture," he .added. "It's hard
times out there.
"We have a project that can't pay
for itself: The slate won't pay for it,
cerlainly the federal government
won't pay for it, and the district can't
pay for it. We've got to be realistic
_about w.ilat our situation is.
Hopefully we'll be able to defend our
water rights,"
Jim Lochhead, chairman of the
CWCB, said the slale could loan the
money for the project at 5 percent if
the district could prove its ability to
pay back the loan.
llBut at $90 an acre-foot, I don't
think there are people. out there to
pay it back," Lochhead said. "If you
can't justify an individual project,
how can you justify the overall
. project?
"I think you're at a critical point
and need to make some decisions;
either to continue 00, dole out the
waler rights, or disband the district.
The board is concerned about the
waler rights and putting the waler to

'.

definitive use,"
David Merritt, project manager
for the West Divide Project study,
said the area receives enough waler
during the spring, but lacks suf.
ficient water during July, August
and September.

Meanwhile, the Denver Water
Board is contesting the West Divide's
diligence decree for the 1980 to 1984
period. The case will go to court Dec.
2.
."If they (the court) agree with
Decve:' illlU cancel Ute decree"
George said, lItheo we will have ~
waler rights. If we built a reservoir
we couldn't even fill it.t1 '

"We've done a lot," George said,
referring to studies, surveys and
lime and cost spent on consulting.
work. "We didn't build anything
though, and that's what they're
quibbling about. But it's so expensive
and tedious to go to court."
George estimates lawyer fees to be
some $48,000 if the trial should last 20
days.
George said he believed a decision
had been reached Friday, "and.
that's that neither the River District
(CRWCD) or the Slate Water Board
(CWCB) is prepared to to go for .ard
on a West Divide proJect."
