<br />-27- <br /> <br />"In my presence the water commissioner gave the <br />man his recommendations which were at great variance <br />with his views. The end result that there is no ditch <br />diversion works at all at present and appears like <br />it won't be reactivated. <br /> <br />. <br /> <br />"Following the flood in 1965 the landowner battle <br />became very bitter and in order to block the will of <br />the majority the man referred to above, visited every <br />state and federal agency even remotely connected with <br />water matters and undoubtedly spoke as deprecating as <br />he could of the water commissioner since the water <br />commissioner did recommend a course of action compat- <br />ible with the majority of the stockholders." <br /> <br />John W. Samples also wrote to Dunbar, on December 20, 1966, <br /> <br />as follows: <br /> <br />"AS to the reported complaint of one designated only <br />as "Nick", I can only presume that this related to one <br />Nick Demitroff. I did not purchase any water stock from <br />Mr. Demitroff, nor did I deliver water to him from the <br />direct flow of the river, Mr. Demitroff rented rights <br />to the Riverside Reservoir and Land Company in 1964, and <br />attached to this letter is a copy of the Riverside Reser- <br />voir and Land Company record concerning this rental and <br />their record of water as delivered under these rights in <br />1964. From what I have been able to determine, Mr. <br />Demitroff is the owner of one Riverside Reservoir right <br />and he rented this right in 1964 to the Riverside District, <br />Mr, Carl Walker was President and Superintendent of the <br />Snyder Ditch which was in very poor condition. The one <br />right owned by Mr. Demitroff and the three rights owned <br />by Walker was all of the water run in the Snyder Ditch <br />which was brought from Jaekson Lake on an exchange basis. <br />I can only again repeat that all of these stories only <br />involve exchanges of reservoir water and I never have, <br />nor for that matter I am sure I never could, even if <br />I so desired, divert flow of water from other appropri- <br />ators." <br /> <br />The Riverside records referred to in the letter are ambiguous, <br /> <br />but seem to indicate rental of the Demitroff water in 1964 by <br /> <br />the Riverside Company. <br /> <br />WOQDWARO.CLYDE.SHERARD AND "'SSOCIATES <br /> <br />:< <br />"'~- ..;.- <br />
