<br /> <br />-. <br />-~~- <br /> <br />-26- <br /> <br />On December 19, 1966 Cecil Osborne, the superintendent of the <br /> <br />Riverside system, wrote a letter to Duke W, Dunbar concerning the <br /> <br />Demitroff allegations, as follows: <br /> <br />"In the case of the person called Nick. His full <br />name is Nick Dimitroff and he does reside in Snyder, <br />Colorado, operating a pool hall, lunch counter and a <br />beer outlet. <br /> <br />"He does not farm l1imself but does own the SW 1/4 <br />SW 1/4 of Section 6, Township 4 North, Range 55 West <br />of the 6th P.M., of which about 30 acres lies under <br />the Snyder Diteh. <br /> <br />"He owns one River.,ide Reservoir Right which the <br />Riverside have rented b~ck for many years on an annual <br />basis. In fact we count on it. <br /> <br />"Since the Snyder Pitch does not have a good direct <br />right and wells of large capacity can be obtained almost <br />anywhere under the system, all of the owncrs of River- <br />side Rights with the exception of a Mr. Gardner and <br />Mr. Dimitroff have sold the Riverside Rights to the <br />Riverside Irrigation Di~trict. <br /> <br />"In 1964 the Snyder Diteh did not run allY water <br />in the spring since thc diversion dam was out and a <br />bitter quarrel developed between the landown@rs as to <br />the nature of the repairs that was to be made, The <br />result was that it grew up in weeds. In lat@ summer <br />one of the landowners owning some Prewitt rights <br />wanted to run them so he repaired the diversion and <br />burned off the weeds. I personally know that the <br />water commissioner tried to persuade him not to try <br />and run his rights for two reasons: <br /> <br />1. The measuring weir is some 2 1/2 miles below <br />the point of diversion, the poor condition of the <br />ditch meant that the shrinkage loss from diversion <br />point to measuring weir that had to be home by <br />others actually wasn't fair to the river, <br /> <br />2. The poor condition of the ditch from the <br />measuring weir to tue man's land would cause the <br />loss of most of his water so the actual good he <br />could accomplish would be negligible. <br /> <br />"The man insisted, the water was turned in and the <br />result was as the commis.,ioner had predicted. <br /> <br />"Following the flood of 1965 the same man pre- <br />vented the ditch from ma~ing an improvement with <br />government funds that would have place it in a good <br />position, <br /> <br />WOODWARO_ClYDE.SIiERAFW AND A~;OCIATE5 <br /> <br />11 <br />
