FEE AS OTHERWISE WOULD HAVE BEEN PAYABLE PURSUANT TO
SUBPARAGRAPH (I) OF PARAGRAPH (b) OF THIS SUBSECTION (1). THE
FEE OF ANY ENTITY WHICH WROTE IN EXCESS OF FORTY THOUSAND
DOLLARS OF TAXABLE PREMIUM, BUT LESS THAN ONE HUNDRED THOUSAND
DOLLARS OF TAXABLE PREMIUM IN THE PREVIOUS YEAR IN COLORADO
SHALL NOT EXCEED THE FEE AS OTHERWISE WOULD HAVE BEEN PAYABLE
PURSUANT TO SUBPARAGRAPH (II) OF PARAGRAPH (b) OF THIS
SUBSECTION (1).".
