<br />Municipal and Industrial <br />Jo;nt project works $ 6,541,000 <br /> <br />Single purpose work for the <br />delivery only of municipal <br />and industrial water 13,761,000 <br /> <br />Irrigation Uses <br />Joint project works <br /> <br />69,946,000 <br /> <br />Power Production and Distribution <br />Joint and single purpose <br />project works 58,756,000 <br /> <br />All of these costs, together with interest at the <br />rate of 3.046 per cent per onnum during construction <br />and thereafter on the cost allocable to municipal and <br />il1dustrial and power uses, ore required to be re- <br />turned to the United States within 50 years from <br />completion of project works. <br /> <br />(e) Reimbursable project construction costs al- <br />locable to irrigation purposes ore beyond the abilily <br />of the irrigation users to return in full within the <br />period prescribed for the return of such costSi it, there- <br />fore, becomes necessary that revenues from the <br />municipal and industrial uses and power uses pay a <br />part of such irrigation cost. <br /> <br />{g) The District, representing the irrigation and <br />municipal and industrial water users for whom the <br />project water supply is intended, desires to contract, <br />pursuant to the Federal Reclamation laws and the <br />laws of the State of Colorado, for the furnishing by <br />the United States to the District, of the project water <br />supply, for which the District will make payment to <br />the United States upon the basis, at the rates, and <br />pursuant to the conditions hereinafter set forth. <br /> <br />(h) It is the intention of the United States and <br />the District that pursuant to this contract and any re- <br />newals thereof, and within the total period prescribed <br />by the authorizing act, there shall have been paid to <br />the United States by the District (a) the cost of pro- <br />iect works allocated to irrigation and assigned to be <br />returned by the District, currently estimated to be <br />$53,568,744 (less whatever credits may accrue on <br />account of payments by other contractors for the use <br />of project works), (b) the cost of project works al. <br />located to municipal and industrial uses (exclusive, <br />however, of any costs of separate single-purpose <br />works for distribution of water for municipal and <br />industrial uses; the costs of such single-purpose works <br />if constructed by the United States will be covered <br />by separate controct or contracts) currently estimated <br />to be $6,541,000 plus interest thereon during ond <br />after construction at the rote of 3.046 per cent per <br />annum, and (c) an appropriate shore of the annual <br />costs of operation and maintenance of proiect works. <br /> <br />4 <br /> <br />o <br />a <br />N <br />o <br />N <br />"""'" <br /> <br />Definitions <br /> <br />(d) "Project water" shall mean 011 woter which <br />accumulates to the use and benefit of the United <br />States and the District through project works - except <br />"winter storage" os defined in paragraph (e) of 'his <br />article. <br />(e) "Winter storage" sholl mean that water <br />which is stored in project facilities, pursuant to exist- <br />ing appropriation rights in the water of the Arkansas <br />River and its fributaries, each year through the fore- <br />bearance of prior appropriators in the District from <br />exercising their direct flow rights during the non- <br />irrigation season, November 1 to April 1, or such <br />other five months' winter period as may be agreed <br />upon by the Secretary, the District and the water <br />users. Winter storage so accumulated during the <br />non irrigation season and no! delivered pursuant to <br />Article 6(c) of this contract to such prior appropriators <br />before the next November' 1 sholl no longer be con. <br />sidered winter storage. <br /> <br />(f) "Initial delivery dale" shall mean the date <br />announced by the Secretary when project water first <br />will be available for furnishing by the United States <br />pursuant to this contract. <br /> <br />(h) "Municipal use" sholl mean the use of water <br />by and through municipalities for municipal purposes, <br />including domestic and industrial use. <br /> <br />(i) "Irrigation use" shall mean the use of water <br />primarily in the production of agricultural crops or <br />livestock, including domestic use incidental thereto. <br /> <br />District's Right to Project Water <br /> <br />4. During the term of this contract and .ony re- <br />newal thereof and subject to the fulfillment of 011 ob- <br />ligations thereunder, the District sholl have the first <br />right to the available proiect woter supply. Upon <br />completion of payment of the amount of the reim- <br />bursable project costs assigned for ultimate return to <br />the United States by the District and subject to pay- <br />ment by the District to the United States of an ap- <br />propriate share of the continuing costs incurred by <br />the United States in its operation and maintenance <br />of project works, the District thereafter shall have a <br />permanent right to the available project water sup- <br />ply. <br /> <br />Initial Delivery Date <br /> <br />5. Whenever construction of project works has <br />progressed to the point that project water can be <br />stored, and project water has accumulated in east <br />slope project reservoirs, in the quantity of 135,000 <br />acre-feet, this being the reserved stored quantity re- <br />quired to assure continued optimum operation of <br />proiect power facilities, the Secretory will give the <br /> <br />5 <br />
