PREAMBLE

The Southeastern Colorado Water Conservancy
Di:3trict wos created by the District Court in Pueblo,
Colorado, on the 29th day of April. , 958, following
the circulation of petitions throughout the nine coun-
ties which stood to derive benefits from the Fryingpan-
Arkansas proiecf.

This brochure, ond others in the series, ore in-
tended to help identify the absolute importance of
water in the Arkansas Valley of Colorado. It 0150 entitled
"The future of ,he Arkansas Valley is its water", and
certainly no statement can better identify the fact
that the one single item which predicates the future
of this area is ifs use of waler. Areas which hove
water con pion for unlimited growth and prosperify.
Others, which hove water in limited quantity, but use
it and prolect it wisely, con have lim.l~ed growth and
prosperity. Those areas which do not plan for future
de.....elopment and use of this precious cornmodity,
hove already established the point and time beyond
which they cannot grow and prosper.

The Fryingpan-Arkansos water project began as
a dream many years ago, when a few visonary men
and women recdized the seriousness of water. 1hey
set about studying the wafer laws of Colorado: the
amounts of wafer to whic.h 1he citizens of this state
were legally entitled, but which they were not using;
the engineering involved in making this water avail-
able to the citizens of Colorado; and the procedures
to be followed in making their dreams 0 reality.
They sifted reoms of information, held countless
in-state and out-af-state meetings, and finally deter-
mined the Fryingpon proiect was the best way to get
Colorado and Arkansas river woter for the present
and future citizens of the semi-arid Arkansas Volley.

On August 16, 1962, President John F. Kennedy
signed the bill passed earlier by the Congress of The
Uniled States creating the Fryingpan-Arkansos proj-
ect. The Southeastern Colorado Water Conservancy
District became the legal agency responsible for
the repayment of the reimburseoble portion of this
multi-million dollar multi-purpose project. The in-
formation contained in this, and other brochures,
explain the critical role being performed by the
District and the serious responsibilities which have
been imposed upon the fifteen men VIIho serve as
dire<:.\o\"'5 lor this agency.

2

, . ~..

o
o
N
-
'-'
N
Q

UNITED STATES
DEPARTMENT OF THE INTERIOR
BUREAU OF RECLAMATION

Fryingpan-Arkonsos Proiect, Colorado

CONTRACT BETWEEN THE UNITED srATES
AND THE SOUTHEASTERN
COLORADO WATER CONSERVANCY DISTRICr

Contract Number 14.06-700-4715

THIS CONTRACT, Made ,his 21st day of Jon,
uary, 1965 in pursuance generally of the Act of June
17, 1902 (32 Stat. 388) and acts omendatory thereof
and supplementary thereto, particularly the Act of
August 16, 1962 (76 Stat. 389), 011 collectively here-
inafter referred to os the Federal Reclamation lows,
be,ween THE UNITED STATES OF AMERICA he'ein.
afrer referred to os the United States, and th~ SOUTH-
EASTERN COlORADO WATER CONSERVANCY DIS,
TRrCT, hereinafter referred to 05 the Di5lrict, 0 corpo-
r01;on of Ihe Stale of Colorado, with il5 principal
place of business at Pueblo, Colorado,

Explanatory Recitals

(0) The United States, acting through rhe Sec-
retory of the Interior, proposes to construct fhe Fry-
ingpan-Arkansos Pro;ect as authorized by the Act of
COflgress approved August 16, 1962 (76 Stat. 389)
for the purpose of supplying water for irrigation,
muniCipal, dornesfic, and industrial uses, generating
and lransmiUing hydroelectric power and energy,
controlling floods, and for other useful and beneficial
purposes.

(c) The limit of expenditures for the construction
of project works as fixed in said authorizing act is
$170,000,000 subject, however, to the ordinary
fluctuations in construction cost indicated by ap-
plicable engineering c051 indexes, and plus expendi-
tures of any sums that may be appropriated for the
operation and mainfenance of the project and for
future costs incurred under Section 4 of the Act of
August 16, 1962 (supm.).

(d) The reimbursable construc1ion cosls of lhe
authorized proiect works., being those allocable to
municipal and industrial uses, irrigation uses and for
the. produc~ion ~nd transmission of electric energy os
esllmated In SOld House Document 187, Eighty-third
Congress, modified as proposed in House Documen1
353, 86th Congress, 2nd Session, and revised as set
out in the document en1itled "Payout Study-Frying-
pan-Arkonsas Project-Colorado (Bosed on 3.046 per
cent interest)" bearing dote of 10-9-63, are estimated
os follows:

3
