Applicant seeks a decree adjudicating a new water right tor the North Zapata Creek Pipeline. The sources of water claimed for the pipeline are North Zapata Creek, Middle Zapd~d Creek, and waters imported into North Zapata Creek from Bout)', Zapata Creek pursuant to other water rights owned by applicant. To the extent that the North Zapata Creek Pipeline diverts water native to North zapata Creek and Middle Zapata Creek, the appli- cation is for a new water right With an appropriation date of 'March 8, 1982 and may be subject to administration for the benefit of senior rights deriving their source of supply in whole or in part from the North and Middle Zapata Creeks. However, applicant reserves all rights he has under Colorado law regarding the administration of said new water right adjudicated to the North Zapata Creek Pipeline. Applicant owns existing water rights decreed from North, Middle and South Zapata Creeks, and intends to continue using such water rights. 8. The new appropriation {or the North Zapata Creek Pipeline from North Zapata Creek and Middle Zapata Creek was initiated by survey of the point of diversion and 10cation of the pipeline on March 8, 1982, The appropriation waS completed with reasonable diligence thereafter, and water diverted by the pipeline, incLUding waters n4tive to the North Zapata Creek and Middle Zapata Creek drainages, was applied to beneficial use beginning on July 9, 1983, in the amount of 12 c.f.s., for the(1 It irrigation of approxi~elY 1347 acres locat~~~ the w~. All requirements of Colorado law have been satis- fied with respect to the application herein, and applican~ therefore is entitled to an absolute decree adjudicating the water right claimed in the application.
