We are <br />looking forward to them. According to this report, there will be 56,200 <br />acres of llew land, including 13,000 acres in the Lower Basin, from which <br />I corp.e, It will furnish supplemental water fOl' 163,100 acres in the Central <br />Utah Project, includ;ng 8,200 acres in the Lowe'r Basin, and will generate <br />1,198,000 kilowatt hours of firm electric power annually. The estimated <br />annual stream flow depletion is 293,000 acre feet, and the estimated cost <br />is in the neighborhood of $257,180,000. <br /> <br />1 am not sufficiently familiar with all the details of the Upper <br />Projects and, therefore, must leave the report to stand for what it is worth. <br /> <br />CHAIRMAN; 'I'd like to ask Mr. Snow a question. Have you <br />been able to de1'ermine the status of the Virgin River and the Kanab ut:\der <br />the Colorado River Compact? <br /> <br />'MR. SNOW; No, and I don't know anybody else who has. 1 <br />would like to know. <br /> <br />CHAIRMAN: Isn't it a fact that those streams are not affected' <br />in any way by the Colorado River Compact, and you have preferred power <br />over aU the flow? Doesn't it say that when there shall be stored an amount <br />of water equal to 5,000,000 acre feet anywhere in the stream, the water <br />rights in the Lower Basin shall beattached to the stored water, and that <br />satisfies all other rights down there but you don't get any water out of <br />the storage; therefore. you are not affected in any way? <br /> <br />MR. SNOW, <br />don't know. <br /> <br />Well, 1 haven't a copy of that compact so I <br /> <br />CHAIRMAN; Those particular streams are not affected in <br />the least by the Colorado River Compact, and you are sitting pret1;r. <br /> <br />MR. HOWARD; If I might volunteer, 1 think consumptive <br />use of that area would be charged against the consumptive use in the <br />Lower Basin. <br /> <br />CHAIRMAN: There's nothing in the compact to lead us to <br /> <br />believe so. <br /> <br />MR. HOWARD: All of the consumptive use in the Lower <br />Basin is charged against the apportionment, regardless of where it is <br />located. That isn't the criterion J it's wherever it occurs. The <br />covenant of never depleting below 75,000,000 acre feet in every ten <br />years, is entirely a separate covenant. <br /> <br />-Zll- <br />
