<br />In order to provide better service in
<br />the Norfolk, Va., Customs district, it is
<br />proposed t.o establish a Customs port of
<br />entry at Charleston. W. Va.
<br />Accordingly. by virtue of the authority
<br />vested in the President by section 1
<br />of the act of August 1. 1914, 38 Stat. 623.
<br />as amended 09 U.S.C. 2). which was
<br />delegated to the Secretary of the Treas-
<br />ury by the President by Executive Order
<br />No. 10289, September i7. 1951 (3 CFR
<br />ch. II), and pursuant to authority pro-
<br />vided by Treasury Department Order
<br />No. 190, Rev. 8 (37 FR 18572), Charles-
<br />ton, W. Va., 1s hereby proposed as a port
<br />of entry in the Norfolk, Va., district (re-
<br />gion Ill).
<br />The proposed geographical limits of
<br />the port of Charleston shall include all
<br />of the area within the corporate limits
<br />of the city of Charleston, W. Va.
<br />Data, views, or arguments with respect
<br />to the foregoing proposal may be ad-
<br />dressed to the Commiss1oner of Customs,
<br />Attention: Regulations Division, Wash-
<br />ington, D.C. 20229. To insure considera-
<br />tion of such communications, they must
<br />be received in the Bureau of CustOlllS not
<br />later than May 17, 1973.
<br />Written material or suggestions sub-
<br />mitted w11l be available for public in-
<br />spection in accordance with ~ 103.3(b)
<br />of the Customs regulations (19 CFR 103.3
<br />(b) ) , at the Bureau of Customs, Regula-
<br />tions Division, Washington, D.C., during
<br />regular business hours.

<br />This notice is pUblished in exercise of
<br />authority delegated by the Secretary of
<br />the Interior to the Commissioner of In-
<br />dian AffaIrs by 230 DM 2 (32 FR 13938).

<br />to the Commissioner of Indian Affairs to

<br />Notice is hereby gIven that it is pro-
<br />posed to revise U 221.16 and 221.17 of
<br />title 25, Code of Federal Regulations,
<br />dealing with the irrIgable lands of the
<br />Flathead Indian Irrigation Project, Mon-
<br />tana, that are not subject to the juriSdic-
<br />tion of the several irrigation districts.
<br />The purpose of the amendment is to es-
<br />tablish the assessment rate for nondis-
<br />trict lands DC the Flathead Indian Irriga-
<br />tion Project for 1973 and thereafter until
<br />further notice.
<br />It is the policy of the Department of
<br />the Interior, whenever practicable, to af-
<br />ford ~he public the opportWllty to par-
<br />ticipate in the rulemaking process. Ac-
<br />cordingly, interested persons may submit
<br />written comments, suggestions, or objec-
<br />tions with respect to the proposed amend-
<br />ment to the Project Engineer, Bureau of
<br />Indian Affairs, Flathead IndIan Irriga-
<br />tion Project, St. Ignatius, Mont.. 59865.
<br />on or before JWle 1, 1973.

<br />Section 221.6 is amended to read as
<br />follows:
<br />
<br />~ 221.16 Charges, Jocko Di,,'ision.
<br />
<br />(a) An annual minimum charge of
<br />$3.67 per acre, for the season of 1973
<br />and thereafter Wltil further notice, shall
<br />be made against all assessable irrigable
<br />land in the Jocko Division that is not
<br />included in an irrigation district organi-
<br />zation, regardless of whether water is
<br />used.
<br />(b) The minimum charge when paid
<br />shall be credited on the delivery of the
<br />pro rata per~acre share of the available
<br />water up to 1 % acre-feet per acre for. the
<br />entire assessable area of the farm unit,
<br />allotment or tract. Additional water, if
<br />available, will be delivered at the rate
<br />of $2.46 per acre-foot or fraction thereof.

<br />Sectlon 221.17 is amended to read as
<br />follows:

<br />(8.) (1) An annual minimum charge of
<br />$4.18 per acre, for the season of 1973 and
<br />thereafter until further notice, shall be
<br />made against all assessable irrigable land
<br />in the Mission Valley Division that is
<br />not included in a i;.riga.tion distrIct
<br />organization regardless of whether water
<br />is used.
<br />(2) The minimum charge when paid
<br />shall be credited on the deli very of pro
<br />rata per acre share of the available water
<br />

<br />up to 1%0 acre~feet per acre for the en-
<br />tire assessable srea of the farm W1it, al-
<br />lotment or tract. Additional water, if
<br />available, will be delivered at the rate

<br />be made against all assessable irrigable
<br />land in the Camas Division that is not
<br />included in an irrigation district organi-
<br />zation regardless of whether water is
<br />used.
<br />(2) The minimum charge when paid
<br />shall be credIted on the delivery of the
<br />pro rata per acre share of the avaUable
<br />water up to 1 % acre feet per acre for the
<br />entire assessable area of the farm Wlit,
<br />allotment or tract. Addltional water, if
<br />available, will be delivered at the rate of
<br />$3.52 per acre foot or fraction thereof.

<br />Notice is hereby given that it Is pro-
<br />prosed to revise ~~ 221.24, 221.26, and
<br />221,28, subchapter T, chapter I of title
<br />25 of the Code of Federal Regulations.
<br />This revision is proposed pursuant to the
<br />authority contained in the acts of Au~
<br />gust 1, 1914 (38 stat. 583), May 18, 1916
<br />(39 Stat. 142). and March 7, 1928 (45
<br />Stat. 210).
<br />The purpose of this amendment is to
<br />establish the lump sum assessments
<br />against the Flathead, Mission, and Jocko
<br />Valley lITigation Districts within the
<br />Flathead Irrigation Project for the 1974
<br />season.
<br />Since this revision will change the
<br />basic rate of operation and maintenance
<br />charges of lands within on irrigation
<br />district, public comment and expression
<br />are deemed adVisable. Accordingly. 1nI-
