County Road 18E <br />Loveland, CO 80537-9711 <br /> <br />--0>) ?s-o <br />'J]ro <br />'-133~ <br /> <br />Dear Mr. Kelso: <br /> <br />In accordance with Section 7 oftbe Endangered Species Act of1973, as amended (16 V.S.C. <br />1531 et. scq.), we reviewed your assessment for potential impacts to federally listed endangered <br />and threatened species associated whh the proposed construction of a pipeline on Bureau of <br />Reclamation land below Pueblo Dam, conm;ction ofa pipeline 10 the South Gotlet Works at <br />Pueblo Dam. an agreement 10 convey non-project water through the South Outlet Works, and a <br />long.tenn contract for storage space in Pueblo Reservoir on an "if and when" basis. <br /> <br />We concur with your detennination of may affect. not likely to adversely affect for the listed <br />species addressed in your South Outlet Works and Pipeline, Conveyance Agreement, and "'fand <br />When" Srorage Environmenlal Assessment (EA). We also concur with the mitigation measures <br />discussed in the EA and recommend avoiding night construction to minimize disturbance to bald <br />eagles potentially roosting in the project area. ThiS commitment has been modilied to show that no <br />construction will take place from one hour before sunset to one hour after sunrise lrom <br />November 1 to March 31 anywhere along the alignment where there is a poteotial10r <br />roosting eagles. These areas will be delineated and agreed upon by the FWS and <br />CDOW prior to oonstruction. <br /> <br />3. <br /> <br />Environmental commitment #3 was developed to minimize impacts to riparian areas. <br />This commitment has been modified to show that tree removal, where unavoidable, will <br />occur from August to November to avoid adverse effects on eawes and nesting <br />migratory birds. <br /> <br />. <br />., <br />
