If any federally-listed threatened or endangered species could potentially be adversely
affected by any activity associated with pipeline construction, this activity will cease and
Reclamation will be promptly contacted to assure appropriate consultation with the FWS.

5. If previously unknown cultural resources are discovered, all work will cease until
Reclamation is contacted and consultation with the State Historic Preservation Office Is
completed.

6. When flows in the Arkansas River downstream of Pueblo Reservoir fall below 50 cfs, the
Board agrees to take up to 17 cfs of its raw water flow at either the Northslde or Southside
diversions rather than through the municipal outlet at the South Outlet Works.

7. The Board will consult with the Colorado Division of Water Resources to assist in
developing a program to further minimize potential adverse effects to aquatic organisms in
the Arkansas River resulting from the combination of conveyance of water via pipeline and
the Winter Water Storage Program.

8. As soon as possible following construction and recontourlng, all disturbed areas will be
revegetated and replanted with native grass and shrub species. Revegetation of grasses
will be by hydromulching or by disking, seeding, mulching, and crimping and approved by
Reclamation and Colorado Division of Parks prior to seeding. The Board will consult with
the Natural Resources Conservation Service to determine the best time of the year for
reseeding and shall reseed during the recommended time period. If necessary, the Board
will plant a cover crop to minimize erosion between the end of construction and when the
permanent revegetation takes place.

9. Excess excavated material will be removed from Reclamation property and disposed of at
an upland site unless an alternative site is approved by Reclamation on Reclamation
property .

10. Reclamation will begin budgeting for additional cultural resource surveys at Pueblo
Reservoir with an emphasis placed on recreation areas and shoreline areas that would be
most affected by the storage contract.

vi
