In accordance with Executive Orders 11988 and 11990, the proposed action will not <br />adversely affect wetlands nor floodplains. <br /> <br />3. Federally-listed threatened or endangered species will not be adversely affected. <br />4. No cultural resources will be affected. <br /> <br />5. Indian trust assets will not be affected. <br /> <br />6. There will be no adverse effects to minority or economically-disadvantaged communities. <br /> <br />ENVIRONMENTAL COMMITMENTS <br /> <br />These commitments were developed to avoid and/or minimize potential adverse environmental <br />effects. Implementation of these commitments will occur before, or during, pipeline <br />construction unless explicitly specified otherwise. <br /> <br />1. Staging areas, haul roads, and other areas affected by associated construction activities will <br />be located in previously-disturbed areas and not in ecologically-sensitive areas. All areas to <br />be disturbed will be reviewed and cleared by Reclamation m:iQr to disturbance. <br /> <br />2. The Board will temporarily establish and physically delineate a 20-foot construction corridor <br />(10 feet on either side of the centerline of the pipeline alignment) through riparian forest <br />habitats along the length of the pipeline alignment. Cottonwood trees greater than 12" in <br />diameter at breast height will not be removed nor disturbed unless they are within the 20- <br />foot construction corridor. The Board will work with Reclamation to preserve these trees <br />between 10 and 15 feet from the centerline; however, there may be situations where, <br />because of construction constraints, some trees in the 10- to 15-foot zone cannot be <br />preserved. To maintain stream channel stability, the Board will exercise diligence to avoid <br />removing any tree from the banks of the Arkansas River. All trees located more than 15 <br />f.eet from the centerline of the pipeline will be preserved during construction. Removal of <br />cottonwood trees greater than six inches in diameter at breast height will be compensated <br />on a 2:1 basis. Appropriate means to protect newly planted trees from beaver will be <br />implemented, and trees will be maintained for at least two growing seasons to assure <br />success. Reclamation and the Colorado Division of Parks will approve tree species that are <br />to be replanted on Reclamation land. <br /> <br />3. To minimize siltation in the Arkansas River, construction of the Arkansas River crossing near <br />the Comanche Pump Station will take place during periods of low flow. This typically occurs <br />following the irrigation season in the fall and before runoff in the spring. The crossing will <br />be constructed using cofferdams so that the entire flow of the Arkansas River is not <br />blocked. Silt fences will be erected for all disturbed areas within 200' of the Arkansas River. <br />The Board shall comply with all terms and conditions of any nationwide, regional, or <br />individual permit issued by the Corps of Engineers for this project. No construction shall <br />take place from one hour before sunset to one hour alter sunrise from November 1 to <br />March 31 at any location along the pipeline alignment where there is potential for roosting <br />eagles. These areas will be delineated and agreed upon by the FWS and CDOW prior to <br />beginning construction. In addition, unavoidable tree removal shall take place from August <br /> <br />v <br />
