<br />Conceptual Request for Proposals <br /> <br /> <br />"', <br />CJl <br />fv <br />...... <br /> <br />reimbur~edby Reclamation upon successful completion ofNEPA compliance <br />(Le., issuance of a categorical exclusion, finding of no significant impact, or <br />favorabl~ rElcord of decision) if required under the terms of the agreement. <br />If the pr,oject sponsor's NEPA compliance costs are to be reimbursed by <br />Reclama,tion, the estimated cost of these activities will be included in the <br />proposed costs for consideration in the cost-effectiveness evaluation, <br /> <br />Reclamation will serve as the lead Federal agency for NEPA compliance, <br />with theiproject sponsor responsible for conducting technical st,udies and <br />analyses, As lead Federal agency, Reclamation will be responsible for <br />evaluatiIj.g technical information and ensuring that environmental and <br />socioeconomic concerns are addressed, In this capacity, Reclamation is <br />solely re~ponsible for determining the appropriate level of NEPA com- <br />pliance, based upon the anticipated magnitude of potential project impacts; <br />Le" categorical exclusion check list, environmental assessment, or <br />environniental impact statement, If as a result of the NEP A process, <br />unforese~n mitigation costs are identified that affect the project's cost <br />effectiveness, Reclamation reserves the right to terminate the agreement <br />and to resolicit proposals. <br /> <br />:', <br /> <br />i <br />1 <br /> <br />"j <br />~ <br />, <br />4 <br /> <br />,j <br />;! <br />~: <br /> <br />In the case of projects that do not require reimbursement of annual <br />operation, and maintenance expenses, no further review or approval by <br />Congressiis required following successful NEPA compliance, and the project <br />sponsor ",ill proceed with design and construction or otherwise implement <br />the projeat under the terms and conditions of the agreement. In the case of <br />projects that require a major commitment of resources to reimburse annual <br />operationiand maintenance expenses, Reclamation will submit the <br />plannin~EPA report to Congress before committing to project funding or <br />authorizing the project sponsor to proceed, <br /> <br />.J <br />'{ <br /> <br />I <br />, <br />i <br /> <br />, <br />') <br /> <br />Reclamation may provide assistance to offerors in developing proposals and <br />NEPA compliance activities when requested to do so by the project sponsor <br />and it is ih the best interest of the Government. Further, Reclamation <br />assistanc~ may be provided to the project sponsor in implementing the <br />project wl'\en requested to do so and it is in the best interest of the <br />Government. The estimated cost of this assistance shall be considered a <br />project co~t and shall be reflected in the cost-effectiveness evaluation when <br />ranking ptoposals. Requests for assistance shall be made in writing to the <br />Contractirlg Officer at the address identified in "Section D, Agreement <br />Administr~tion Data," along with supporting justification. <br /> <br /> <br />Reclamatiiln may provide direct assistance to the project sponsor when the <br />proposed r;!roject has other associated indirect benefits of Federal interest; <br />i.e" other '\Vater quality or environmental benefits, The cost of this <br />assistance will not be considered a project cost, <br /> <br />C-3 <br /> <br />
