for a review of the state of the art at regular intervals and the

installation of any new or improved pollution control facilities

i

~\

we have some degree of contractual responsibility.

Court Actions

'Despite these efforts we have been named in two court actions

seeking to stop our operations and we are threatened

with a court action in a third. One is to prohibit intrusion of

Lake powell into Rainbow Bridge National Monument. The other court

action would stop construction of the Peripheral Canal in the Delta

'\
i

of California's Central Valley, even though this project has not yet

even been considered for authorization, let alone construction. It

would also block the Eastside Canal and the San Luis Drain and stop the oumpin~

operations of the Central Valley project and the State Water Plan.

/

Since they are before the court it is not my purpose to comment

on these actions other than to point out that irreparable damage will

~"
\

result if either suit is successful. We have obtained and have carried

out the suggestions of highly qualified specialists in environmental

protection in these instances as in other areas of Bureau of Reclamation

operations.

We believe we are on the right track in environmental protection

I~/,'
I' ,
.

and enhancement measures which findings of the court can substantiate.

Nevertheless, actions of this kind can create damaging operational

delays and create wrong and unfavorable impressions in the public mind

which roake your consideration of resource utilization proposals more

difficult.

K 3114

K
12

K

~
