<br />-16- <br /> <br />- <br /> <br />.' <br /> <br />The Juniper project could have a major impact on the water <br />available to the Yampa River if 'Constructed to anywhere <br />near its full decreed capacity. The full decreed capacity <br />of the Juniper Reservoir is a substantial portion of the <br />total flow of the Colorado River at Maybell. Potentially, <br />the Juniper project could place calls on the River which <br />would seriously impair the operation of the Public Service <br />Company rights. <br /> <br />A subst.an:tiaL-p=ticm~f. ,~n..-f-+n~ r>1,,)'lia;ll-~~i::Ly~d f~~ <br />- tr1butaries including the Elk and Williams Fork Rivers and <br />Oak, Elkhead, Fish and Fortification Creeks. If constructed, <br />the Juniper Reservoir would not deplete the river flow by <br />the full amount decreed and would not be expected to call <br />for its full storage capacity every year. It is believed, <br />however, that the existence of such a large and still active <br />conditional decree when considered with other conditional <br />decrees that can reasonably be expected to be developed and <br />the Upper Colorado River Compact commitment does constitute <br />a potential impairment of junior conditional decrees. <br /> <br />-,I <br />.~ <br />I <br /> <br />The Four Counties Project includes claims for 75 cfs from <br />Harrison Creek and 50 cfs from a tributary of Harrison Creek. <br />The conditional rights have been sold or optioned to Colorado- <br />Ute Electric Association which has filed for a change of <br />water rights in the DivisiCln 6 Water Court (Case No.-W-I091-------- <br />76). The change would make the Yampa River basin an alter- <br />nateplace of use and add a number of points of diversion and <br />. <br />places of storage for the Four County water rights which <br />were originally decreed for out-af-basin diversion. The <br />application also requests a change in use to irrigation. <br />industrial, power and energy generation, mining, recreation <br />and all other beneficial uses with the right to make succes- <br />sive use until 100 percent of the water has been consumptively <br />used.
