<br />-14- <br /> <br />,- <br /> <br />The generated flows of the Yampa River and Elk River at the <br />Saddle Mountain Pump Station diversion sites do not always <br />equal or exceed the decreed amount of 65 cfs per site. At <br />the Yampa River Pump site the generated flow drops below <br />65 cfs in 8 months out of the 240 month study period. while <br />at the Elk River Pump site the generated flow drops below <br />65 cfs in 7 months out of the 156 month study period. The <br />combined flow of the sites drops below 130 cfs for 7 months <br />in 1977. If the pump station were constructed so that water <br />:t'om-ea~ - -caC:Lon -simultane-ously ,and <br />shortages below 65 cfs at either site could be supplemented <br />by flow from the other site, then the supply to both sites <br />would be insufficient in only 7 months, all in 1977. This <br />shortage could be supplemented by release from the Hinman <br />Park Reservoir. <br /> <br />j <br /> <br />Legal Availability <br /> <br />The legal availability of a supply to the righ~s is dependent <br />on the priority and location of the rights and the degree <br />of administration of the system. The Yampa and Elk Rivers <br />are not fully appropriated at this time, and according to <br />the water commissioner there has never been a call placed <br />on these rivers. Thus the most important factors affecting <br />the Public Service Company rights are the number and mag- <br />nitude of senior conditional rights on the Yampa River and <br />the administration of the Colorado River and Upper Colorado <br />River compacts. <br /> <br />I <br />u_1 <br /> <br />. <br />.. <br /> <br />There are a number of conditional water rights on the Yampa <br />River and its tributaries that could affect the water avail- <br />able to the Public Service Company's rights if perfected and <br />exercised.
