(1)(a). <br /> <br />(b) The Colorado water conservation <br />board may expend on each project specified in <br />paragraph (a) of this subsection (1), from <br />such moneys as are or may hereafter become <br />available to the Colorado water conservation <br />board construction fund, the amounts of money <br />listed in said paragraph (a) plus or minus <br />such amounts, if any, as may be justified by <br />reason of ordinary fluctuations in <br />construction costs as indicated by the <br />engineering cost indices applicable to the <br />types of construction involved for such <br />projects or as may be justified by reason of <br />changes made in the plans and specifications <br />of the project if those changes are required <br />by finalized engineering drawings and <br />specifications or by federal or state <br />requirements. The board's cost toward any <br />project specified in paragraph (a) of this <br />subsection (1), ~xcept for the Rio Grande <br />Reservoir project, shall not exceed fifty <br />percentum of the total cost of constructing a <br />project. <br /> <br />(c). . . [Notwithstanding the statutory <br />prohibition against grants,] $619,500 of the <br />board's costs for the Rio Grande Reservoir <br />project shall be non-reimbursable in <br />recognition of the fact that the state shall <br />receive the right from the owner of the <br />reservoir to use a portion of the said <br />reservoir's storage capacity for the purposes <br />of meeting Colorado's obligations under the <br />Rio Grande compact . . . and maximizing the <br />use of compact-allocated waters in Colorado. <br />The board shall not expend any non- <br />reimbursable monies on the Rio Grande <br />Reservoir project until the state engineer <br />certifies to the board that an operating <br />agreement satisfactory to him for the state's <br />use of the reservoir for compact purposes has <br />been agreed upon. Said operating agreement <br />shall be incorporated into the contract <br />between the board and the project sponsor. <br />The exception set forth herein. . .[to the <br />prohibition against grants] is necessitaten <br />by the terms of the Rio Grande compact. . .. <br />The general assembly recognizes that as a <br />result of the compact the rehabilitation of <br />precompact reservoirs is the only effective <br />way of fulfilling the mandates of this <br />section with respect to the Rio Grande waters <br />within the state of Colorado. <br /> <br />321 <br />ai/23/enc <br />
