<br />co <br /> <br />,-.1 <br />o <br />.-! <br />'_J <br />e:;. <br /> <br />. <br /> <br />. <br /> <br />(2) authorize such additional funding for the District as <br />is needed for temporary, stopgap repairs this winter, such <br />funding to be subject to the same conditions set forth in item <br />(1) , <br /> <br />(3) not authorize any funding for permanent repairs and <br />take the position that such funding will require new authorizing <br />legislation (upon which a decision need not be made until the <br />Board's January meeting), <br /> <br />(4) defer the annual payment due from the District on <br />June 1, 1986, and extend the repayment period from 40 to 41 <br />years, <br /> <br />(5) confirm the position I have taken that the District <br />must take any and all steps necessary to protect all avenues of <br />recovery which the District may have against Wheeler, Avery, and <br />the issuers of the surety bonds taken out by Avery as a condition <br />of the Board's making more funding available pursuant to (1) and <br />(2) above, <br /> <br />(6) ask the Attorney General to continue to work <br />cooperatively with the District's lawyers on behalf of the Board <br />to assist in determining what steps should be taken to protect <br />any and all avenues for recovery, and <br /> <br />(7) ask the Attorney General to advise the Board, at its <br />next meeting, on what steps, including litigation, it may be <br />appropriate to take at that time. <br /> <br />JWM/gl <br /> <br />Enclosure: as stated <br /> <br />MEMORANDUM <br /> <br />-5- <br /> <br />November 5, 1985 <br />
