<br />. <br /> <br />Coo) <br />Coo) <br />,.. <br />c.v <br /> <br />. <br /> <br />. <br /> <br />CHAPTER V <br /> <br />WATER AND POWER REPORTS <br /> <br />Upon completion of the Secretary's review and the incorporation of com- <br />ments, the reports will, be termed the Secretary's Proposed Report and Draft <br />Environmental Statement. To fulfill environmental review requirements, the <br />reports will be filed with the Environmental Protection Agency and distributed <br />to the public, various organizations, and a large number of governmental agen- <br />cies for review. A notice of availability will be published in the Federal <br />Register marking the beginning of a 60-day minimum period in which to submit <br />written comments on the Environmental Statement. In addition, no sooner than <br />30 days after the Federal Register notice, a formal public hearing on the en- <br />vironmental statement will be held in the study area to formally receive oral <br />comments from any concerned citizen or group. At the same time, as required <br />for the feasibility report, the Commissioner will circulate the reports to af- <br />fected states and concerned Federal agencies for a 90-day minimum review of <br />the Secretary's Proposed Report. <br /> <br />, <br />'. <br /> <br />;" <br /> <br />Comments on the draft environmental statement will be addressed in a final <br />environmental statement prepared by the field and regional offices. In addition, <br />comments on the feasibility report during the 90-day review will be incorporated. <br />Before the reports are approved in final form by the Commissioner of Water and <br />Power, they will be sent to the Water Resources Council in Washington for a 60- <br />day minimum review. <br /> <br />After making any revisions necessitated by the Council's review, the Re- <br />gional Director will again submit the reports to the Commissioner. After the <br />Commissioner's approval, the reports will be submitted to the Secretary of the <br />Interior as the Commissioner's Report and Final Environmental Statement. Upon <br />approval by the Secretary they will be filed with the Environmental Protection <br />Agency and distributed by the Regional Director and the Commissioner to those <br />who submitted comments on the Draft Environmental Statement. A Notice of <br />Availability will be published in the Federal Register, and after a 3D-day <br />waiting period the reports will be transmitted to the President, through the <br />Office of Management and Budget, as the Secretary's Report and Final Environ- <br />mental Statement. <br /> <br />In accordance with Council on Environmental Quality regulations, at the <br />time a decision is made to recommend action, a public record of decision must <br />be prepared by Water and Power and transmitted with the reports and other rec- <br />ords. This record will state what the decision was, identify all alternatives <br />considered, and state whether all practicable means to avoid or minimize en- <br />vironmental harm were adopted. <br /> <br />On the bases of the documents just described, the Congress will be able <br />to make decisions concerning construction of the unit or other appropriate <br />action. <br /> <br />20 <br /> <br />, <br />
