<br />O~0228 <br /> <br />2 <br /> <br />5. The head of the Federal grantor agency and the Comptroller <br />General of the United States, or any of their duly authorized <br />representatives, shall have access to any books, documents, <br />papers, and records of the State and local governments and <br />their subgrantees which are pertinent to a specific grant <br />program for the purpose of making audit, examination, <br />excerpts and transcripts. <br /> <br />6. Unless otherwise required by law, no Federal grantor <br />agency will place restrictions on State and local governments <br />which will limit public access to the State and local govern- <br />ments' records except when records must remain confidential <br />for the following reasons: <br /> <br />a. Prevent a clearly unwarranted invasion of personal <br />privacy. <br /> <br />b. Specifically required by Executive order or statute <br />to be kept secret. <br /> <br />c. Commercial or financial information obtained from a <br />person or a firm on a privileged or confidential basis. <br /> <br />d. Any other information which can be exploited for the <br />purpose of personal gains. <br />
