<br />. <br /> <br />. <br /> <br />The Division Engineer/CWCB will track development under senior conditional rights and <br />consumptive use under water rights junior to the in stream flow right. <br /> <br />The instream flow right is not administered with respect to junior water rights until the Carve <br />Out, distributed on a monthly basis, is used up either by senior conditional water rights or <br />junior water rights. <br /> <br />When the Carve Out has been used up on either a monthly or annual basis, and the instream <br />flow is not met, the instream flow right is in priority and a call will be placed against all juniors <br />developed in excess of the Carve Out.. The call will be for the amount of the remaining <br />component (Paragraph 3 or 4) of the instream flow right. <br /> <br />If the Carve Out is not sufficient to meet water development needs, the Board would be able <br />to convert Paragraph 4 water from instream flow protection to development uses.
