<br />.. , <br /> <br />0410 <br /> <br />-4- <br /> <br />Nlf) In order to accomplish the objectives set forth in the <br />immediately preceding subdivision hereof, the same being lettered <br />(0), each city undertakes to exercise due diligence, within legal <br />limitations and subject to economic feasibility, To that end, the <br />City and County of Denver and the City of Colorado Springs shall, <br />respectively, submit to the Secretary of the Interior on or before <br />Dccembcr 31st of each calendar year, beginning with the year 1957. <br />a report showing by months for the water year ended Septembey 30th <br />last past, the quantities of water diverted by the rcporting city <br />from the Colorado River System, and whether and to what extent such <br />water vms used directly or placed in storage. lifter each city <br />commences use of Blue River water said report shall also show by <br />months for the same period the quanti ties of return flow from their <br />municip:l.l uses of such Colorado Idver' "!atGr accruing to the Sou.th <br />Platte River and to Fountain Creek, respectively, a; measured at <br />the <Jauging stations provided for herein. Each such report shall <br />allJO show what steps, by legal action or othenvise, the reporting <br />city has taken during the period covered by thc report to utiliz,e <br />such return flow by exchange or otherwise to the extent water of <br />the Colorado River System is included therein, so as to reduce or <br />minimi ze the demands of such city upon Blue Ri vo r "lUte r. The Uni ted <br />StatE,s of America reserves the dqht, at any time after use of Blue <br />River' water com1nences hereunder, to apply to '.this Court for injunctive <br />or other remedial orders, suspending or proportionately reducing <br />diversions or imposing conditions upon the taking of Blue Rive'( water <br />by the pal.ticular city, if the United States shall establish as a <br />fact that the particular city has failed to exercise due diligence <br />in taking, with respect to return flow of water of the Colorado River <br />System, all steps ,.,hich, in view of legal limitations and economic <br />feasibi Ii ty, might reasonably be requi red of suoh city in establishing, <br />enforcing, utilizing or operating a plan designed to accomplish said <br />reduction by such city of its Blue River water use. <br /> <br />"(g) The City and County of Denver and the City of Colorado <br />Springs will utilize Blue River "later for municipal purposes and no <br />other within their metropolitan areas. Such metropolitan area shall <br />be limited to such an area as is reasoi1ahly integ:(ated with the de- <br />velopment of Denver or Colorado Springs, as the case may be. To the <br />extent that those municipalities utilize water beyond their respective <br />metropolitan areas from sources other than the Dlue River, or lease. <br />or permit oUwrs to utilize waters from other sources for purposes <br />other than municipal in character, the Blue River water diversions <br />will be reduced pro tanto, Providecl that the limitations in this <br />subparagraph shall not apply in the case where electrical energy is <br />produced by such water as an incident to its use for municipal <br />purposes. <br />
