AND ITS TRIBUTARIES <br /> <br />19. There V01"e d8creod to the City and County of Denver by <br />the Distric-L Court of Summit County, Colorado, Hater District No. 36, <br />in Civil Actions No. 1805 and 1806 the following rights to th8 use <br />of water: <br /> <br />a. J'ontezuma Tunnel <br /> <br />6-24-46 <br />6-24-46 <br /> <br />788 Sec. Ft. <br /> <br />b. Dillon Reservoir <br /> <br />252,678 Acre-feet. <br /> <br />Reference to the Stipulation, as amended, which is set <br />forth above, is made in regard to these rights to the UBe of water. <br /> <br />The rights of the City and County of Denv8r to the use of <br />"later in the'Blue River and its tributaries arc more fully described <br />in the decrees entered in Water District No. 36, Civil Actions No. <br />1805 and 1806. Insofar as they describe the rights to the use of <br />water adjudicated to the City and County of Denver those decrees are <br />incorporated into these' Findings of Fact and Conclusions of Law by <br />reference and made a part of them as fu:lly as though they were set <br />forth in full herein. <br /> <br />20. Colorado Springs has had decreed to it by the District <br />Court of Summit County, Colorado, ~!ater District No. 36, the follm'l- <br />ing rights to the US8 of water: <br /> <br />a. Continental-Hoosier Diversion Syst8m, August 5, 1929, a <br />final decreed right of 77 c.Ls., and a conditional right of 10 c.f.". <br />of August 5, 1929. <br /> <br />b. Continental-Hoosier DiveTsion System, "ay 3.3, 1948, 400 <br /> <br />c.f.s. <br /> <br />c. Continental-Hoosier Diversion Syst8m, l~ay 13, 1918, a <br />total storage 5,306 acre-feet. <br /> <br />Reference is here made to the Stipulation, as amended, and <br />her8inabol'e'set forth, which, with the exception herein noted, per- <br />tains only to the Colorado Springs 1948 rights described in sub- <br />paragraphs b. and c. last above; tl18 1929 priority right s ment ioned <br />in subparagra.ph a. last above apply and ar8 p8rtinent only for the <br />purpose of computing the division of "Jater between D"mv8r and Colorado <br />Springs as provided in paragrRph 7(a) of said Stipulation. <br /> <br />Provided, however, that thoss diversions described in sub- <br />paragra~ilis a, b, and c above, will b8 mad8 S0181y for municipal <br />purposeS; iJ.bj8ct nevertheless to the right of 1:110 parties to the <br />
