<br />2. The River District shall allocate to the Fish Pool <br />a percentage of the Wolford Mountain Reservoir <br />inflow, which can be lawfUlly stored by the River <br />District for beneficial use by releases for the <br />endangered colorado River fish, subject to <br />Reservoir operations required for flood control and <br />other lawful purposes. The percentage of such <br />inflow allocated to the Fish Pool will be as <br />follows: <br /> <br />a. When unfilled capacity is available in each of <br />the three Pools, 10 percent will be allocated <br />to the Fish Pool. <br /> <br />b. When unfilled capacity is available in the <br />Fish Pool and the west Slope Pool but the <br />Denver Pool is full, 14.5 percent (6/42) will <br />be allocated to the Fish Pool. <br /> <br />c. When unfilled capacity is available in the <br />Fish Pool and the Denver Pool but the west <br />Slope Pool is full, 20 percent (6/30) will be <br />allocated to the Fish Pool. <br /> <br />d. When unfilled capacity is available in the <br />Fish pool only and both the Denver Pool and <br />the west Slope Pool are full, 100 percent will <br />be allocated to the Fish Pool. <br /> <br />3. under the conditions described above, the Fish Pool <br />will have a firm annual yield of 2,400 acre-feet. <br />Operational studies conducted by the District <br />indicate that the service can expect the f"ollowing <br />~"itions would prevail b--ed upon a simulation of <br />a; 1963 to 1994 period of record (Appendix B) : <br /> <br />a. '1!I1e annual averaqe yield of the Pish Pool is <br />~,650 acre-feet. <br /> <br />b. A full yield of 6 I 000 acre-feet is available <br />to the Pish pool in 27 of 33 years. <br /> <br />4-. 'l'be Fish POol watsr stored as provided berein shall <br />be released at the discretion of the service. 'l'h_ <br />protection of the releases will be accomplished <br />pursuant to the terms of a separate arp:eement <br />between the River District and the ewes- (herein <br />referred to as the CWCB MDA) which shan provide <br />for the delivery and protection of. tbat water <br />instream to and through the Subj ect Reach pursuant <br />to the Section 7 Enforcement Aqreement between CWCB <br />and the service. <br /> <br />4 <br />
