<br />~~~\) <br /> <br />CONSTRUCTION STAGE STIPULATIONS <br /> <br />i <br />As referred to in Condition 29 of the T~nne1 and Diversion Easement Deed <br />between the United States, acting through the Regional Forester, and the <br />Grantee, the Grantee will carry out the terms of the following Stipulation <br />during the Construction Stage. The Construction Stage begins when construc- <br />tion activities are ready to commence Oil land administered by the Forest <br />Service and compliance with Easement Conditions Numbers 20, 21, 22, and 23 <br />has been demonstrated to the Forest Service. Construction Stage ends when <br />the Forest Service and the Grantee mutua1~y agree that any work done there- <br />after will be considered as operation or maintenance, EXCEPT, that the <br />Forest Service reserves the right to reihstate the terms of this Stipula- <br />tion when the Grantee subsequently submits plans for reconstruction or <br />alteration of the project works covered br the aforesaid easement. <br /> <br />The following terms of this Stipulation apply to the Grantee: <br /> <br />1. CONSTRUCTION PLANS: <br /> <br />Prior to the start of any construc~ion or reconstruction on the area <br />authorized by this grant, the Grant~'e shall submit final construction <br />plans and specifications for approv 1 by the Forest Service. A copy <br />of the approved plans will become a ,part of this easement and will be <br />retained in the office of the Forest Supervisor at G1enwood Springs, <br />Colorado. <br /> <br />2. OPERATING PLAN: <br /> <br />Prior to beginning construction oJ the project, the Grantee shall <br />prepare an Operating Plan for the project for approval by the Forest <br />Supervisor.' Approval of the Ope~ating Plan will be based upon <br />requirements deemed necessary by the Forest Supervisor for proper <br />management of the project. The Operating Plan shall include but not <br />be limited to the following: <br /> <br />a. A schedule for the development ~nd construction of all facilities <br />needed for the project. The schedule shall include a list of <br />planned improvements and the s~heduled date for completion. The <br />Grantee may accelerate the sche~u1ed date for construction of any <br />improvement authorized, provi d$d the other schedu1 ed pri ori ti es <br />are met and that all authorized! priority installations are com- <br />pleted to the satisfaction of ~he Forst Supervisor prior to the <br />scheduled due date. All required plans and specifications for <br />site improvement and structu~es included in the construction <br />schedule shall be submitted t01the Forest Supervisor at least 45 <br />days before the construction d~te stipulated in the development <br />schedule. A fire plan that details the fi~e prevention, presuppression, and <br />suppression measures that wi1,1 be taken by the Grantee, its <br />employees, contractors, and subcontractors and their employees in <br /> <br />14 <br />
